Hearings are held at City Hall, 1 Dr. Carlton B. Goodlett Place, Room 408, Fourth Floor, San Francisco, CA.  The closest accessible BART Station is the Civic Center Station located at the intersection of Market, Hyde and Grove Streets.  Accessible curb side parking has been designated at points along McAllister Street. Effective January 21, 2001, the Board of Supervisors amended the Sunshine Ordinance by adding the following provision: The ringing of and use of cell phones, pagers and similar sound-producing electronic devices are prohibited at this meeting.  Please be advised that the Chair may order the removal from the meeting room of any person(s) responsible for the ringing or use of a cell phone, pager, or other similar sound-producing electronic devices.

Notice is hereby given to the general public and to owners of the subject property and other property within 300 feet that an application for variance under the Planning Code as described below has been filed with the Zoning Administrator and will be considered at a PUBLIC HEARING to be held on the date, time, and place listed on the first page of this Calendar:

 

A.      CONSENT CALENDAR

 

All items listed hereunder constitute a Consent Calendar and are considered to be routine by the Zoning Administrator.  There will be no separate discussion of these items unless a member of the public so requests, in which case the matter shall be removed from the Consent Calendar and considered as a separate item at this time or at a future hearing.

 

(SARA VELLVE)

1.            2012.1214V:    777 BUENA VISTA AVENUE WEST, Lot 007 in Assessor's Block 1256 in a RH-3 (Residential, House, Three-Family) Zoning District and a 40-X Height and Bulk District.

 

FRONT SETBACK VARIANCE SOUGHT:  The proposal is to construct a one-story vertical addition to the existing two-story, two-family dwelling, the south corner of which will be in the required front setback along the front (east) property line. The proposal also includes a three-story rear horizontal addition, which is not subject to the Variance.

SECTION 132 OF THE PLANNING CODE requires a minimum front setback of approximately 15 feet for the subject property, measured from the front property line. The south corner of the proposed third story would extend to within approximately 11 feet of the front property line and encroach into the required front setback; therefore, a variance is required.

B.      REGULAR CALENDAR

(ADRIAN PUTRA)

2.            2011.0896V:    225 SANTA ANA AVENUE, Lot 018 in Assessor's Block 3254 in a RH-1(D) (Residential- House, One Family- Detached) Zoning District and a 40-X Height and Bulk District.

 

REAR AND SIDE YARD VARIANCES SOUGHT:  The subject property contains a one-story over garage single-family dwelling.  The project proposes to raise the height of the existing building by approximately 2’-0” to create a habitable level below the existing first floor and to construct a two-story horizontal addition at the rear (southeast corner) of the building that would not extend beyond the depth of the existing rear wall. 
PER SECTION 133 OF THE PLANNING CODE the subject property is required to maintain two side yards of approximately 4' each.  The existing building currently provides side yards of approximately 1' on the south side and 3' on the north side.  Therefore, the proposals to raise the existing building and construct a horizontal addition at the rear (southeast corner) require a variance.

PER SECTION 134 OF THE PLANNING CODE the subject property is required to maintain a rear yard of approximately 24'-0".  The existing building currently provides a rear yard of approximately 17'-6".  Therefore, the proposals to raise the existing building and construct a horizontal addition at the rear (southeast corner) require a variance.

REAR YARD VARIANCE SOUGHT:  The project is to legalize an existing basement level deck, stairs and enclosure located below an existing 1st floor deck at the rear.  The project also involves the addition of 1-hour rated firewalls along the west and east sides of the basement level deck.    

PER SECTION 134 OF THE PLANNING CODE the subject property is required to maintain a rear yard of approximately 20'-0".  The rear addition proposed for legalization along with the construction of new firewalls encroach 14'-6" into the required rear yard, resulting in a rear yard of approximately 5'-6".  Therefore, the proposal to legalize the rear deck, stairs and enclosure at the basement level requires a variance.

4.            2013.0146V:    2335 15TH AVENUE, Lot 008 in Assessor's Block 2344A in a RH-1(D)(Residential- House, One Family- Detached) Zoning District and a 40-X Height and Bulk District.

 

REAR YARD VARIANCE SOUGHT:  The project proposes to enclose a second floor rear deck on the southwest corner of the dwelling. This existing structure currently encroaches into the required rear yard, thereby requiring a rear yard variance to allow enclosure of the deck.

PER SECTION 134 OF THE PLANNING CODE the subject property is required to maintain a rear yard of approximately 20'-6".  The existing structure encroaches 12'-10" into the required rear yard. The proposed deck enclosure would encroach approximately 10'-4" into the required rear yard and result in a rear yard of approximately 10'-2" at point of the addition. Therefore, the project requires a variance from the rear yard requirement of the Planning Code.

REAR YARD VARIANCE SOUGHT:  The project includes removal of an existing rear stairway (to grade) and construction of a new rear stairway (to roof) to access a new roof deck.

PER SECTION 134 OF THE PLANNING CODE the subject property is required to maintain a rear yard of approximately 45 feet.  The proposed rear stairway with landing would encroach approximately 20 feet into the required rear yard and result in a rear setback of approximately 25 feet; therefore, the project requires a variance from the rear yard requirement of the Planning Code.

6.            2013.0187V:    760-762 NOE STREET, Lot 093 in Assessor's Block 3603 in a RH-2(Residential- House, Two Family) Zoning District and a 40-X Height and Bulk District.

 

REAR YARD VARIANCE SOUGHT:  The proposal includes replacing an existing fire escape with a new deck and spiral staircase on the second floor, at the southeast corner of the dwelling. The existing fire escape is a noncomplying structure as it currently encroaches 3.7 feet into the required rear yard. The new deck and stairway will extend 5 feet into the required rear setback.

PER SECTION 134 OF THE PLANNING CODE the subject property is required to maintain a rear yard of approximately 15 feet. The proposed rear addition would encroach approximately 5 feet into the required rear yard and result in a setback of approximately 10 feet; therefore, the project requires a variance from the rear yard requirement of the Planning Code.

7.            2013.0143V:    672 MOULTRIE STREET, Lot 013 in Assessor's Block 5722 in a RH-1(Residential- House, One Family) Zoning District, 40-X Height and Bulk District, and the Bernal Heights Special Use District.

 

MASS REDUCTION AND PARKING VARIANCES SOUGHT:  The proposal is to construct an approximately 19-foot rear horizontal expansion of the existing second floor.

PER SECTION 242(e) (3) OF THE PLANNING CODE the subject property must provide at least 650 square feet of mass reduction. The proposal provides less than 100 square feet of mass reduction. Therefore, the project requires a mass reduction variance.

PER SECTION 242(e) (4) OF THE PLANNING CODE the subject property must provide at least 2 independently accessible off-street parking spaces. The existing house contains no garage or off-street parking, and the proposal does not add any parking. Therefore, the project requires a parking variance.

8.            2012.1075V:    43 POWERS AVENUE, Lot 005 in Assessor's Block 5518 in a RH-2(Residential- House, Two Family) Zoning District and a 40-X Height and Bulk District.

 

REAR YARD VARIANCE SOUGHT:  The proposal is to expand the existing rear deck on the second floor, build a new roof deck on the third floor/attic level, and extends the stairs to connect the second and third floor decks.

PER SECTION 242(e) OF THE PLANNING CODE the subject property is required to maintain a rear yard of 33 feet 9 inches. The existing second floor rear deck and stairs are built completely within the required rear yard, leaving a rear yard of approximately 12 feet 6 inches.  The proposal would expand the deck at the second level and add stairs to a new third floor deck.  The proposal would maintain a rear yard of approximately 12 feet 6 inches on the second floor, and approximately 15 feet 6 inches on the third floor; therefore, the project requires a variance.

9.            2013.0241V:    176 - 8TH AVENUE, Lot 030 in Assessor's Block 1367 in a RH-2 (Residential- House, Two Family) Zoning District and a 40-X Height and Bulk District.

 

REAR YARD VARIANCE SOUGHT:  The proposal is to construct a 15 foot horizontal addition at the rear of the ground floor and second floor of the three-story, two-unit building.  The proposed project includes a 4 foot setback at the south property line and new rear decks at the second and third floors and demolition of the existing rear stairs. 

SECTION 134 OF THE PLANNING CODE requires a minimum rear yard depth of approximately 51 feet for the subject property, measured from the rear property line.  The subject property currently provides a 49 foot rear yard. The proposed expansion would extend 15 feet further into the required rear yard, providing a rear yard of approximately 34 feet for the subject property.

REAR YARD VARIANCE SOUGHT:  The proposal is to construct a spiral staircase in the required rear yard that would provide access to the rear yard from the second story unit.  Currently, the subject property does not have a Code-complying rear yard.  The proposal will encroach approximately four feet into the required rear yard.

Planning Code Section 134 requires a minimum rear yard of 15 feet. A Code-complying rear yard is not currently provided and the proposed staircase would be located within the required rear yard.

REAR YARD MODIFICATION VARIANCE SOUGHT:  The proposal is to construct a new four-story over basement mixed-use building with three dwelling units and ground floor commercial space.  

PER PLANNING CODE SECTIONS 134, the subject property is required to maintain a rear yard equal to 25% of the depth of the lot on all levels of the building, or 28.5 feet for the subject lot. The proposed building will extend 21 feet into the required rear yard at the ground and basement levels, resulting in a 7.5-foot rear yard at those levels; therefore, the project requires a rear yard modification.

REAR YARD VARAIANCE SOUGHT:  The proposal is to demolish and replace in-kind the existing two-story rear stairs and deck.  The new stairs and deck will be the exact same size and in the same location as the existing stairs and deck.  

PER PLANNING CODE SECTIONS 134, the subject property is required to maintain a rear yard equal to 45% of the lot depth, equal to 51 feet for the subject lot. The proposed replacement stairs will maintain a 29.5-foot rear yard; therefore, the project requires a variance from the rear yard requirement (Section 134) of the Planning Code.

The proposed reconfigured stairs and enclosure will provide a 29-foot rear yard; therefore, the project requires a variance from the rear yard requirement of the Planning Code.

The proposed demolition and reconfiguration of the stairway and new 1 hour fire wall will be located on the rear property line; therefore, the project requires a variance from the rear yard requirement of the Planning Code

15.          2013.0230V:    3964 20TH STREET -- on the north side of 20th Street between Church and Sanchez streets in an RH-1 (Residential, House, One-Family) Zoning and in the Dolores Heights Special Use District and a 40-X Height and Bulk District.

 

REAR YARD VARIANCE SOUGHT:  The proposed work is to add a stairway, at the rear of a two-story, single-family dwelling. The proposed stairway would provide a direct connection between the second floor and the rear yard.

PER SECTION 241 OF THE PLANNING CODE, the subject lot is required to maintain a minimum rear yard depth of 51 feet 4 inches, measured from the rear property line. The proposed second floor stairway will have a 42 foot setback from the rear property line encroaching 9 feet 4 inches into the required rear yard.

C.      PUBLIC COMMENT:

 

At this time, members of the public may address the Zoning Administrator on items of interest to the public that are within the subject matter jurisdiction of the Zoning Administrator except agenda items.  With respect to agenda items, your opportunity to address the Zoning Administrator will be afforded when the item is reached in the meeting.  Each member of the public may address the Zoning Administrator for up to three minutes.

 

The Zoning Administrator will not take action on any item not appearing on the posted agenda, including those items raised at public comment.  In response to public comment, the Zoning Administrator may:

 

(1)          respond to statements made or questions posed by members of the public;  or

(2)          request staff to report back on a matter at a subsequent meeting; or
