Amendments to Administrative Code Concerning a Child Care Feasibility Study  [BOS File No. 10-1094] - Hearing of a proposed Ordinance that would amend the San Francisco Administrative Code by adding Chapter 29B to require a City agency, or a private developer that receives City funds for a development project, as defined, to prepare a feasibility study for providing an on-site child care center whenever it plans to construct or purchase a building, lease more than 50 percent of space in a private building for an initial term of more than one year, or alter more than 50 percent of the space in an existing building; adopting findings, including environmental findings. The Commission will consider an Ordinance introduced by Supervisors Dufty and Alioto-Pier that would amend the Administrative Code as described in the Ordinance with additional modifications as recommended by the Planning Department and making environmental findings.

5.         Commission Comments/Questions

        Inquiries/Announcements.  Without discussion, at this time Commissioners may make announcements or inquiries of staff regarding various matters of interest to the Commissioner(s).

        Future Meetings/Agendas.  At this time, the Commission may discuss and take action to set the date of a Special Meeting and/or determine those items that could be placed on the agenda of the next meeting and other future meetings of the Planning Commission.

 

Commissioner Moore:

The American Planning Association yesterday nominated the Ferry Building and its open spaces as one of the ten great public spaces of America for 2010.  This goes hand and hand with North Beach having been nominated two years ago as one of the great neighborhoods in the United States.  We have two down and a couple to go and I’m very happy about this.

Commissioner Antonini:

For those of you who are old enough to remember the 1950’s and early ‘60’s in San Francisco; it was a city known for its style, its manners, its class and its cleanliness.  Lately, often in the national press we are pointed out, perhaps unfairly, as being a place that is characterized by rude and inappropriate behavior and sometimes as being un-disciplined.  I’m not sure that is fair, but what I was impressed with was our San Francisco Giants after their win over the Braves when they stayed on the field and were respectful of Bobby Cox, who had been a manager for 33 years and spend his whole life in baseball, and his moment was much more important than their triumph in terms of the scope of baseball.  That really showed a lot of class.  That specific mention, not only for the Giants and for [   ], but he mentioned San Francisco because the team is often representative of the city in which they reside.  I think it was very good for San Francisco – that choice to do the right thing and be respectful.

Commissioner Borden:

Yesterday, I was at the San Francisco Heritage event.  There was a really wonderful young woman who is a graduate student who did a presentation on a plan she did looking at Market Street.  I thought it might be interesting if she did that presentation here at the Commission as an informational item.  I thought it was a great plan and would be of interest to the public.

Commissioner Miguel:

During the past week I have met with representatives of AT&T, and some of the items that are before us today – Elizabeth Street, 1095 Market Street and the [   ] Triangle.

Commissioner Moore:

I heard that yesterday evening, during the Giants game, even the ballpark was able to participate in recycling at a level highest in the country.  So they followed with an incredible performance and I just wanted to mention that because I thought it was a great achievement given the excitement and distraction which occur when you are at a big gathering like that.  It was a really great performance.

Commissioner Miguel:

It’s jarring to me when I travel outside of San Francisco and are given Styrofoam containers and there is no place to dispose of recycling disposal.  We forget what we have here.  California is better than any other state I’ve seen.  San Francisco, by far, is the high point of the state.  If you go to the mid-west or visit family in New York …, its just jarring because we get so accustomed to it here. 

Commissioner Sugaya:

I have a procedural issue.  Last week when I was not in attendance, when I was recused from the North Beach Library Environmental Report, apparently Mr. Martinez from the Historic Preservation Commission was giving a report.  And my concern is that he apparently was given only three minutes as a member of the public.

Commission Secretary:

That is not true.  I did not have the clock on him.

Commissioner Sugaya:

Well somebody said he got cut off.

Commission Secretary:

I did not have the clock on any presenter from the city.

Commissioner Miguel:

He finished and I said ‘thank you.’

Commissioner Sugaya:

Al right, so my information was wrong then.

My other issue is that the Historic Preservation Commission consideration of the DEIR was only on the Wednesday before the Thursday meeting.  I hope in the future that if there are DEIR’s with historic resource comments being made by HPC, that those meetings be held at least a week or two head of ours so that we can be the beneficiary of their minutes.

Commissioner Moore:

I think that would be a procedural matter and I have personally talked to Commissioner Martinez, that the Historic Preservation Commission starts to accept rules by which they on their own start to request that, because I would agree sometimes I would like to hear their opinion a little earlier, study it and bring it into the context of all the other things we are looking at.

6.         Director’s Announcements

 

Director Rahaim:

I would also like to mention the APA Award.  I attended the ceremony and spoke on behalf of the Department and the Commission.  I thanked the APA for that award.  There were 10 awards given this year for great places in America and that ceremony took place in front of the Ferry Building yesterday with the CEO of APA, Paul Farmer, who also happened to be my boss for some years.  It was very nice to receive that award on behalf of the city.  Because there were concerns about early public release, they didn’t let me know until the end of last week that this was even happening.  So I had very little time to let any of you know.  But it was a very nice event.

           

7.         Review of Past Week’s Events at the Board of Supervisors, Board of Appeals, and Historic Preservation Commission.

 

BOARD OF SUPERVISORS:

        The Board did not meet this week – no report  

 

BOARD OF APPEALS

        281 Turk Street – Appeal of over-the-counter building permit for a pharmacy retail use.  The permit was appealed by neighbors concerned about the proliferation of illegal prescription drug sales.  The Board voted 4 -1 to deny the permit because of potential negative impacts on the neighborhood.  (Person, Goh, Hwang and Fung voted in support of denial; Garcia opposed the vote.)  The Board of Appeals suggested that the neighbors request additional land use controls from the Planning Commission and Board of Supervisors and request additional police presence from the Police Commission.

 

HISTORIC PRESERVATION COMMISSION

        The HPC did not meet yesterday – no report

HARRY TRACY WATER TREATMENT PLANT (HTWTP) TC "Harry Tracy Water Treatment Plant (HTWTP)" \f A \l "1"  LONG-TERM IMPROVEMENTS PROJECT - Certification of the Final Environmental Impact Report - The San Francisco Public Utilities Commission (SFPUC) is proposing  TC "San Francisco Public Utilities Commission (SFPUC)" \f A \l "1" to implement the Harry Tracy Water Treatment Plant (HTWTP) TC "Harry Tracy Water Treatment Plant (HTWTP)" \f A \l "1"  Long-Term Improvements Project to meet WSIP levels of service for water quality and delivery reliability, seismic reliability, and other improvements necessary to the enhance the operation of the HTWTP. The treatment process would generally be the same even with the proposed improvements. The primary differences would be to solids handling, whereby solids from the sludge holding tank would be transferred to a solids dewatering facility before being trucked off site, and to the treated water storage, which would occur in a single new tank north of the main plant site instead of two tanks southeast of the main plant. The HTWTP is located on 52.3 acres in an unincorporated area of San Mateo County just east of Interstate 280 (I-280) TC "Interstate 280 (I-280)" \f A \l "1"  near the City of San Bruno and the City of Millbrae. A small portion of the site is within the City of Millbrae.

Preliminary Recommendation: Certify the Environmental Impact Report

NOTE: The public hearing on the Draft EIR is closed. The public comment period for the Draft EIR ended on May 17, 2010. The Planning Commission does not conduct public review of Final EIRs. Public comments on the certification may be presented to the Planning Commission during the Public Comment portion of the Commission calendar.

Mission District Streetscape Plan - The Mission District Streetscape Plan is a community-based plan that identifies innovative strategies to improve streets, sidewalks and potential for new public spaces at underutilized right-of-way locations in the Mission District.  The project’s boundaries are Division Street on the North, US Highway 101 on the east, Precita Avenue, Mission Street and San Jose Avenue on the south and Dolores Street on the west. The project conducted 5 public workshops between March 2008 and April 2010 and identified 28 specific projects throughout the plan area.  The draft plan will be released on October 7th 2010. A Preliminary Mitigated Negative Declaration was published on June 10, 2010.

Preliminary recommendation: No Action requested - Informational Presentation

STANDARDS FOR BIRD-SAFE BUILDINGS - Informational hearing to announce the public release of a draft document titled "Standards for Bird-Safe Buildings." This document is intended to promote bird-safe design and to reduce bird collisions into buildings.  The draft document proposes a three-pronged approach to the problem: 1) establishment of requirements for the most hazardous conditions; 2) use of an educational checklist to educate project sponsors and their future tenants on potential hazards; and 3) creation and expansion of voluntary programs to encourage more bird-safe practices including acknowledging those who pursue certification through a proposed new program for “bird-safe building” recognition. The draft document discusses potential negative impacts on resident and migratory birds, suggested remedies to lessen the hazard through treatments for glazing, lighting, and other building design elements and building operations.

Preliminary Recommendation: The Department recommends that the Commission instruct the Department to 1) collect public comment through the end of 2010; 2) consider revisions to the document based upon comments received; and 3) prepare a draft Ordinance for the Commission’s consideration in 2011 that would implement proposed controls and adopt a final "Bird-Safe Building Standards" document; and 4) adopt the attached Draft Resolution.

SAN FRANCISCO 2009 HOUSING ELEMENT - Information update on the 2009 Housing Element update - The Housing Element is a public policy document that addresses issues relating to housing needs for San Francisco residents. The Housing Element is prepared in response to Government Code section 65580 et seq. California housing element law, which requires local jurisdictions to plan for and address the housing needs of its population for attainment of state housing goals. The City has undergone a community planning process and released a second draft of the element in June. This hearing seeks Commission input and direction on the Draft 2009 Housing Element Update.

G.        PUBLIC COMMENT

 

At this time, members of the public may address the Commission on items of interest to the public that are within the subject matter jurisdiction of the Commission except agenda items.  With respect to agenda items, your opportunity to address the Commission will be afforded when the item is reached in the meeting with one exception.  When the agenda item has already been reviewed in a public hearing at which members of the public were allowed to testify and the Commission has closed the public hearing, your opportunity to address the Commission must be exercised during the Public Comment portion of the Calendar.  Each member of the public may address the Commission for up to three minutes.

 

The Brown Act forbids a commission from taking action or discussing any item not appearing on the posted agenda, including those items raised at public comment.  In response to public comment, the commission is limited to:

 

(1)  responding to statements made or questions posed by members of the public; or

(2)  requesting staff to report back on a matter at a subsequent meeting; or

(3)  directing staff to place the item on a future agenda.  (Government Code Section 54954.2(a))
