B.        STAFF REPORT AND ANNOUNCEMENTS

Preservation Coordinate Frye reported that the Preservation Team held a retreat last week at the Randall Museum to talk about process, historic resource evaluations, CEQA, and ways to better serve the commissioners and fellow planners at the Department.  The Department was assigning a committee with the task to improve plans, streamline and provide clear information within the Certificate of Appropriateness (C of A) case report.  He asked the commissioners for a volunteer to serve on that committee to develop a better structure to expedite the C of A case report.  Commissioner Martinez volunteered.

2.         President to appoint Commissioner to attend the October 27, 2011 Planning Commission hearing regarding Articles 10 and 11.

President Chase appointed himself. Commissioners Martinez and Johns volunteered and were appointed.

4.         Disclosures

[On August 17, 2011, at a public hearing on its Rules and Regulations, the HPC approved continuing its practice of allowing Ex Parte Communications with required disclosure.]

Commissioner Martinez talked with Peter [Ackworth] about the Armory and with Nancy Shanahan.

Vice President Damkroger had email correspondence with Nancy Shanahan about revisions to Article 11.

President Chase had telephone communications with Nancy Shanahan concerning Articles 10 & 11.

49 JULIAN AVENUE, adjacent to Landmark No. 108, the Mission Armory, east side of Julian Avenue between 14th and 15th Streets, in Assessor’s Block 3547, Lot 032   Request for Review and Comment on the proposed project. The project requires Conditional Use authorization under Planning Code Sections 215(a), 175.6(e)(1)(c), 151.1 and 303 to allow the demolition of an existing one-story, industrial building and the construction of a new approximately 10,500-square foot, 50-foot tall, five-story residential building containing eight dwelling units and eight ground floor parking spaces utilizing its  Eastern Neighborhoods Pipeline status per Planning Code Section 175.6(e) to elect to conform to the controls under the former C-M (Heavy Commercial) Zoning District and the 50-X Height and Bulk District, while conforming to Articles 1, 1.2, 1.5 and 2.5, as amended by the Eastern Neighborhoods Controls, or requesting Conditional Use authorization to seek relief from those amended Articles.  The project site is currently in the UMU (Urban Mixed Use) District and a 45-X Height and Bulk District.  Conditional Use authorization is required to (1) construct dwelling units in the C-M Zoning District per Planning Code Section 215(a), and (2) seek relief from the parking requirement per Planning Code Sections 175.6(e)(1)(c) and 151.1 where a maximum of six spaces are allowed and eight spaces are proposed.

Preliminary Recommendation:  The Historic Preservation Commission may direct staff to draft written comments of the Commission to be forwarded to the Planning Commission for its November 10, 2011 hearing.

PRESENTER: Tony [Cameron], Land Use Planner, represented project sponsor; Joe [Montedore], from Firm Architectural Firm, worked with the Armory’s renovation and remodel; Peter [Ackworth], Owner of Armory.

NOTE:            HPC directed staff to draft a letter to express the Commission’s general support for moving the project forward.  The draft letter included several points: acknowledgement that this area is historically a dense and mixed-use area; the project sponsor to provide disclosure up front to potential owners that the residential units are adjacent to an assembly space; to encourage new use and development, the Commission asked that the project sponsor work with the Department staff and/or representative from HPC or ARC to create a set-back for that portion of the building that potentially blocks light to the [Drill] Court; that staff would extrapolate the Residential Guidelines for windows along the property line.

7.         2011.1048U                                                                      (M. SMITH: 415/558-6322)

1020 FRANCISCO STREET, north side between Polk and Larkin Streets, in Assessor's Block 0476, Lot 002C.  Request for Review and Comment on the nomination of the property to the National Register of Historic Places.  The subject property is located within a RH-1 (Residential, House, One-Family) District and a 40-X Height and Bulk District.

Preliminary Recommendation: Send resolution of findings recommending to SHPO to approve nomination of the subject property to the National Register

PRESENTER: Mathew [Dilhofer], Principal of MGD Environmental Design, represented the property owner and applicant.

ACTION:         Approved the nomination to the National Register under Criteria B and G and to have some mention of her studio space.

GLEN PARK COMMUNITY PLAN HISTORIC RESOURCE SURVEY - Adoption of Survey Findings. The Glen Park Community Plan survey consists of a historic context statement; field survey information for 162 individual properties; historic resource/non-resource evaluations for approximately 15 individual properties; and evaluations of several areas that contain groupings of buildings, none of which was found to be an eligible historic district. The study area covers approximately 11 City blocks included in the Glen Park Community Plan. The general boundaries of the study area are: Chenery Street to the north; Bosworth St., Joost St. and San Jose Avenue to the south; Elk Street to the west; and Natick Street to the east.

Preliminary Recommendation: Adopt survey Findings

SPEAKERS:   Bruno Peguese, BART Property Development Department Principal Officer, was concerned about the broadness of the statement that concluded Glen Park Bart Station could likely be listed on the California Register as a historic resource.  He would like to make a modification to the survey that would allow BART the right to review the entire BART property if it had any plans in the future; Bruce [Bonaker], associated with Glen Park Associates, would like to pursue the landmarking of the BART Station. He would also like to include the 30-foot round “Contemplation Circle” at the corner of Bosworth and Diamond Streets and hopes to reach a compromise solution with the BART; [Tora Teague], Resident of Glen Park, asked for clarification on whether or not any of the 161 parcels the survey had done that none of them would be eligible for historic registers, except for the Glen Park BART station, or, would any site be changed ever to become historical.

NOTE:            Commissioner Damkroger directed staff to answer questions posted by the speakers.  In response to speaker Tora Teague’s question, Mr. Corrette said staff identified resources included 601 Bosworth Street, 547, 831-17, 831, 683, 701-03 Chenery Street, 2784-86 Diamond Street, Glen Park Elementary School, and the BART Station.  In response to the concern raised by speaker Bruno Peguese, Mr. Frye said there was limited budget for the survey.  Only general information was provided about the BART Station that it appeared to be eligible as a potential historic resource.  The information could be reviewed any time in the future to identify features that might be considered as character defining if there was a project.

PLANNING CODE CONTROLS FOR HISTORIC PRESERVATION.  The Commission will consider a proposed Ordinance sponsored by the Planning Department that would amend the Planning Code controls for Historic Preservation, including but not limited to Articles 10 and 11.  The Planning Commission reviewed proposed amendments on August 5, 2010 and recommended approval with minor modifications of various Code Sections to the Board of Supervisors.  The Historic Preservation Commission began a parallel review of the proposed amendments in 2010 on the following dates: July 21st, August 4th, 18th, September 1st, 15th, and 29th, October 6th 15th, and 21st, November 3rd and 17th, and December 1, 2010.  The Historic Preservation Commission is considering further modifications prior to sending recommendations to the Planning Commission and the Board of Supervisors, and began this re-review at its August 17th, 2011 public hearing, and continued the review at its September 7th, September 21st,  and October 5th, 2011 public hearings.

Preliminary Recommendation:  Approve with modifications.

Deliberation on Article 10

SPEAKERS:   Nancy Shanahan and Aaron Peskin commented on Article 10; [Name not clear from recording], Chair of Coalition of SF Land Use Committee, opposed Supervisor Wiener’s proposed changes.

ACTION:         Approved proposed changes to Article 10 with modifications as amended and agreed to in this hearing, without the inclusion of proposed Article 10 amendments from Supervisor Wiener.

Deliberation on Article 11

SPEAKERS:   Nancy Shanahan commented on Article 11.

ACTION:         Motion of Intent to approve Article 11 with changes referenced in this hearing and pending the review and approval of City Attorney, without the inclusion of proposed Article 11 amendments from Supervisor Wiener.

NOTE:              President Chase asked fellow Commissioners concurred on scheduling a discussion on Supervisor Wiener’s requested changes to Articles 10 & 11 for the next hearing.
