678 PORTOLA DRIVE - north side between Woodside Avenue and Sydney, Lot 004 in Assessor’s Block 2892 - Request for Conditional Use Authorization, pursuant to Planning Code Sections 209.6(c) and 303 to establish a new wireless telecommunication services (WTS) facility by replacing three omni antennas with nine panel antennas to be mounted and concealed within a church steeple, as part of the AT&T wireless telecommunications network in a RH-1(D) (One-family, Residential, Detached) Zoning District, and a 40-X Height and Bulk District.

            Commission Comments/Questions

·         Inquiries/Announcements.  Without discussion, at this time Commissioners may make announcements or inquiries of staff regarding various matters of interest to the Commissioner(s).

·         Future Meetings/Agendas.  At this time, the Commission may discuss and take action to set the date of a Special Meeting and/or determine those items that could be placed on the agenda of the next meeting and other future meetings of the Planning Commission.

 

Commissioner Miguel:

Rather than comment earlier, I thought I would save it for here, as to the possibility of
an offsite meeting in December regarding Park Merced, there was comment from Commissioners here that was affirmative in that regard. I've spoken with a number of people from that area and  organizations, as well as with the Mayor's Office of Economic, and Work Force Development. I am sure we will hear from later this afternoon as well on Park Merced
and the concept is that doing such a truthfully massive and extremely involved project on
which we are going to -- and we will hear more in detail later
this afternoon, a number of informational hearings, was the thought that those particular
matters regarding the project that are of most interest to the
residents, the tenants, and the general neighborhood, would best be heard there. And so I have, actually, been working with Director Rahaim and with the Mayor's Office, the Economic Work Force Development to determine which items would be heard there, which ones would normally be heard here, any actual votes would be done here, I know it's an unusual situation. Not that totally difficult to accomplish and we will get more details, as we go along.

 

Commissioner Moore:

I support what you said. It's a very large community and we need to be out there doing what we do. I was extremely proud to hear national television label us as the most beautiful City in the country which we obviously all know. We all try to contribute to keeping it that way, but it was wonderful to hear. I want to commend the City on how well they organized the thing, that not a speck of anything, orange, black, or  whatever, when you walk across the big plaza down the streets. it's remarkable with so many present that they organized it as well as they did. It was fabulous to watch and I am happy the City was able to pull it off that well.

 

On another note, I attended a meeting last night at the Southeast Community Center, Candlestick Point state recreation area,  the parks service presented the plan. It was a number of people that come here that showed up. What I was concerned about, and I am not speaking about the design and how it's being done, but there's a slight disconnect bringing the Candlestick Hunter Point forward to open space connections. The design as presented last night does not seem to be fully on top of the knowledge and the breadth of what was done in that plan. I hope there will be a meeting of minds for those two groups that come together and work out where the marches need to occur. The other thing I want to talk about is there are two items which were settled and off our calendar today, those are items 12 and 14. And I want to comment on the weakness and short comings of the drawings which accompanied both of these projects. I am continuously dismayed and have been for many years that we are not encouraging more consistent sets being submitted to us, relative to what is depicted and how it is depicted. I would probably call these two drawings remotely sophomoric. Perhaps my first year of architecture school, that's about where this is. For this Commission that is not consistent or appropriate to render the type of decisions we need to make and I want to help and empower the Department that generally we are raising the bar of what is being expected as a minimum for visual depiction in these applications. Sometimes we see window sill details and foundation details which don't really matter. But what we really want to see is how does it fit the context of the neighborhood, to how does it meet the Department's guidelines to determine them. Three dimensional or whatever, but these sets are way short of what the Department should be able to expect. Just want to put that into the discussion and see if we can help, perhaps, develop a set of criteria to help the Department.


Commissioner Antonini:

Like all of us thrilled with the Giants World Series Victory, particularly it happened on Monday so we aren't sitting here biting our nails for the possible seventh game today. I might have been there, but in any case, it was a thrill to walk up the same steps today
that the Giants walked down on the entrance to City Hall and this does rekindle our image as a City which we used to be known as 80 years ago. That has fallen by the wayside recently, but the way it was handled yesterday, between the City, the Giants, and the Project Sponsors, how well it was done.

On a smaller scale, but also I think of equal importance, today was the first round of golf tournament out at Harding Park, which was the champions, and some of the names that my age is more familiar with, Tom Watson and Fred couples are among the participants out there. It's the second major tournament in two years there will be another, and I would like to acknowledge the former and present supervisor who were instrumental in refurbishing Harding Park and making it great for local golfers and world champions alike. I am optimistic we can do the same thing in the future with our other capital assets, and improve them and bring them back to their former greatness so a good step in the right direction, thank you.

 

Commissioner Sugaya:

I am going to wear former Commissioner Bill Lee's hat for a moment. The Traveler Magazine has named San Francisco the most favorite City for travel in the U.S., so -- and I just wanted to comment on Commissioner Moore's Candlestick Park. I am sure they are going to have a lot of time to come to a meeting of the minds given the State budget and the failure of prop 21.

101350  Supervisor Daly  Ordinance amending the San Francisco Planning Code by amending Sections 151, 151.1, 155, 161, 249.1, 249.23, and Part VII of Article 9 (1) to remove minimum parking requirements and establish maximum parking limits in M-1, C-M, and South of Market districts and the Folsom and Main Residential/Commercial and Fourth and Freelon Streets Special Use Districts to make them consistent with those of neighboring districts, (2) to require that non-residential and non-hotel parking in C-3 in the South of Market Mixed Use districts adjacent to Downtown maintain a fee structure which discourages long-term commuter parking, (3) to make parking controls in the Mission Bay Districts that are subject to the Planning Code consistent with requirements of neighboring districts; and (4) adopting findings, including environmental findings, Section 302 findings, and findings of consistency with the General Plan and the Priority Policies of Planning Code Section 101.1.

1645 PACIFIC AVENUE - assessor’s Block 0595 Lot 013 – Certification of the Final Environmental Impact Report. The project site is a 15,959-square-foot parcel located on a block bounded by Pacific Ave., Polk St., Jackson St., and Van Ness Ave. in the Russian Hill neighborhood. The proposed project would demolish the existing commercial building and replace it with a new 65-foot high building with 48 residential units, ground-level retail uses, and 49 parking spaces. The project site is within the Polk Street Neighborhood Commercial District (Polk NCD) and 65-A Height and Bulk District.

NOTE: The public hearing on the Draft EIR is closed. The public comment period for the Draft EIR ended on January 19, 2010. The Planning Commission does not conduct public review of Final EIRs. Public comments on the certification may be presented to the Planning Commission during the Public Comment portion of the Commission calendar.

1645 PACIFIC AVENUE - south side between Polk Street and Van Ness Avenue; Lot 013 in Assessor’s Block 0595 - Request for Conditional Use Authorization, pursuant to Planning Code Sections 121.1, 271, and 303 to grant exceptions to bulk requirements and to allow development of a lot larger than 10,000 square feet, within the Polk Street Neighborhood Commercial District, and the 65-A Height and Bulk District, and the adoption of findings under the California Environmental Quality Act. The proposed project is to demolish an existing building containing automotive repair and parking uses and a portion of another automotive repair building, and to construct a new six-story over basement building containing approximately 39 dwelling units, 40 off-street parking spaces, and approximately 3,200 square feet of ground-floor commercial uses.

Consideration of an Ordinance related to Mobile Food Facilities and Temporary Uses - Initiated by Supervisor Bevan Dufty under Board File Number 101351, this Ordinance would make amendments to the Planning Code including adding Section 102.31 to define a Mobile Food Facility, amending Section 205 and adding Section 205.4 to establish a new category of temporary uses, and amending Sections 212, 790.91, 790.93 and 890.90 to clarify that Mobile Food Facilities need not be conducted within enclosed buildings.

AMENDMENTS TO THE SOUTH OF MARKET YOUTH AND FAMILY SPECIAL USE DISTRICT - The Planning Commission will consider a Planning Code Amendment to Section 249.40A, as proposed by an Ordinance introduced at the Board of Supervisors (Board of Supervisors File No. 101093 (Daly)).  The proposed Ordinance would increase affordable housing requirements in the SoMa Youth and Family Special Use District, bounded generally by Natoma Street on the north, Harrison Street on the south, 4th Street on the east, and 7th Street on the west. The increase would be from the City’s baseline affordable housing requirements (15% on-site or 20% off-site/in-lieu) to the Eastern Neighborhoods “Tier C” affordable housing requirements (22% on-site or 27% off-site/in-lieu) for projects tangent to the following streets within the Special Use District: 4th St., 5th St., 6th St., 7th St., Howard St., Folsom St., and Harrison St.

Preliminary Recommendation: Recommend disapproval of the proposed Ordinance.

PROPOSED COMMISSION-SPONSORED PLANNING CODE AMENDMENTS RELATED to the Upper Market Street Neighborhood Commercial District - The Planning Commission will consider a Resolution to recommend adoption of amendments to the Planning Code. The amendments are intended to apply new development impact fees and design controls to the existing neighborhood commercial district.  The draft ordinance would amend the San Francisco Planning Code including amendments to Sections 134, 145.4, 151.1, 155, 207.7, 207.8, 263.20, 401, 416 et seq., 421.1, 421.3, 421.5, 721, and 721.1 as the sections relate to the Upper Market Street Neighborhood Commercial District (Upper Market NCD) and to extend the Market and Octavia Community Infrastructure Fee area to include the Upper Market Street Neighborhood Commercial District lying outside the Market and Octavia Plan area.  The controls will amend the parking and loading requirements; require ground floor commercial on this portion of Market Street; amend certain design requirements; and make other amendments; adopting findings, including environmental findings, Section 302 findings, and findings of consistency with the General Plan and the Priority Policies of Planning Code Section 101.1.

Amendments to the Planning Code Residential Inclusionary Affordable Housing Program.  [BOS FILE NO. 10-1095] -  Hearing of a proposed Ordinance that would amend amending the Residential Inclusionary Affordable Housing Program, Planning Code Sections 415 et seq. to exempt certain Qualified Student Housing Projects, as defined, if the project meets certain requirements; and making findings including environmental findings.  The Commission will consider an Ordinance introduced by Supervisor Dufty that would amend the Planning Code as described with additional modifications as recommended by the Planning Department and making various findings including environmental findings, Planning Code Section 101 and 302 findings, and General Plan consistency findings.

PARK MERCED MIXED-USE PROJECT OVERVIEW AND DEVELOPMENT AGREEMENT – INFORMATIONAL ONLY – Parkmerced is generally bounded by 19th Avenue to the east, Lake Merced Boulevard to the west, Holloway Avenue to the north, and Stanley Boulevard to the south.  The proposed project includes those lots owned by Parkmerced Investors, LLC, and includes Assessor’s Blocks 7303, 7303A, 7308-311, 7314, 7316, 7319-26, 7330-45, 7333 A-B, 7333E & 7353-7373.  Parkmerced is a rental housing complex constructed between 1941-1951 consisting of approxmiately 3,200 existing residential units and owned by Parkmerced Investors, LLC.  Informational Hearing to provide an overview of the proposed project components and draft Development Agreement. The project, which would be implemented over 20-30 years in multiple phases, includes the addition of approximately 5,700 net new residential units, the demolition and replacement of approximately 1,800 existing units which would remain subject to the San Francisco Rent Stabilization Ordinance, rent-protections and relocation rights for existing tenants, re-alignment and re-design of streets and blocks, re-alignment and improvement of the M Ocean View light rail line, the addition of new neighborhood serving retail and office space, new and re-configured public open spaces including neighborhood parks, pedestrian and bike paths, athletic fields, a new organic farm, and community gardens, overall transportation improvements, ecological hydrology improvements, and provision of renewable energy and water infrastructure. The draft Development Agreement would become the binding legal contract between the City and the Developer and would memorialize all of the public benefits and obligations of the Developer and associated agreements between both parties toward implementation of the Project.

Preliminary Recommendation: No Action Requested. Informational Discussion Only.

3575 GEARY BOULEVARD (THE INSTITUTE ON AGING) – south side between Arguello Boulevard and Stanyan Street; Lots 010 and 011 in Assessor’s Block 1084 (formerly Block 1083, Lot 2 and Block 1084, Lot 4) - Request for Conditional Use Authorization under Sections 174 and 303 of the Planning Code to modify a Condition of Approval (#D(3)) as previously imposed under Planning Commission Motion No. 17219 relating to a Conditional Use authorization for Case No. 2003.0410CEK! approved on April 6, 2006, and modified by the Board of Supervisors in its Motion No. M06-55 on May 23, 2006, which approved the demolition of the Coronet Theater and the construction of a six-story mixed use project that includes 120 affordable dwelling units for seniors, 30 supportive housing units for seniors with special needs, office, meeting and senior health services space and 95 off-street parking spaces in an NC-3 (Moderate-Scale Neighborhood Commercial) District and an 80-A Height and Bulk District. The current proposal is to modify the previously-imposed condition to eliminate the requirement for 28 valet parking spaces, for a total of 67 spaces. Valet parking will be provided for large meetings/conferences with 50 or more attendees.
