Commission Meeting Procedures

Material submitted by the public for Commission review prior to a scheduled hearing should be received by the Planning Department reception counter at 1650 Mission Street, 4th floor, no later than 5:00 PM the Wednesday (eight days) prior to the scheduled public hearing. Persons unable to attend a hearing may submit written comments regarding a calendared item to: Planning Commission, 1650 Mission Street, Suite 400, San Francisco, CA 94103-2414. Comments received by 11:00 AM on the day of the hearing will be made part of the official record and will be brought to the attention of the Planning Commission at the public hearing. Otherwise, submit material related to a calendared item at the scheduled hearing for distribution. For complete distribution to all Commissioners, necessary staff and case/docket/correspondence files, submit an original plus 10 copies. When sending e-mail correspondence to Commissioners, please copy the Commission Secretary at: linda.avery@sfgov.org

Pursuant to Government Code Section 65009, if you challenge, in court, (1) the adoption or amendment of a general plan, (2) the adoption or amendment of a zoning ordinance, (3) the adoption or amendment of any regulation attached to a specific plan, (4) the adoption, amendment or modification of a development agreement, or (5) the approval of a variance, conditional-use authorization, or any permit, you may be limited to raising only those issues you or someone else raised at the public hearing described in this notice, or in written correspondence delivered to the Planning Commission, at, or prior to, the public hearing.

Commission action on conditional-uses and reclassification may be appealed to the Board of Supervisors within 30 days. Call (415) 554-5184 for more information. Commission actions after Discretionary Review may be appealed to the Board of Appeals within 15 days of action by the Central Permit Bureau. Call (415) 575-6880 for more information. Zoning Administrator action on a variance application may be appealed to the Board of Appeals within 10 days of issuance of the written decision.

The Commission has instituted a policy that, in most cases, they will not call an item for consideration after 10:00 PM. If an item is scheduled but not called or introduced prior to 10:00 PM, the Commission may continue the matter to the next available hearing. Items listed on this calendar will not be heard before the stated time.

Cell Phone and/or Sound-Producing Electronic Devices Usage at Hearings

Effective January 21, 2001, the Board of Supervisors amended the Sunshine Ordinance by adding the following provision: The ringing of and use of cell phones, pagers and similar sound-producing electronic devices are prohibited at this meeting. Please be advised that the Chair may order the removal from the meeting room of any person(s) responsible for the ringing or use of a cell phone, pager, or other similar sound-producing electronic devices (67A.1 Prohibiting the use of cell phones, pagers and similar sound-producing electronic devices at and during public meetings).

1349 CLAY STREET - between Jones and Leavenworth Streets, Lot 033 of Assessor's Block 0220 - Request for Conditional Use Authorization to allow a proposed addition to an existing building in excess of 40 feet in height. The project proposes to add two stories to an existing two-story over basement building, renovate the existing facade, add decks at the fourth level and the roof, and add an elevator/stair penthouse, solar array, and wind turbines to the roof. The finished roof would reach a height of approximately 59 feet. As permitted by the Planning Code, the wind turbines and portions of the rooftop structures would exceed the 65-foot height limit, up to a maximum height of approximately 75 feet. The number of existing dwelling units will not change. The project site is located within the RM-3 (Residential Mixed, Medium Density) Zoning District and the 65-A Height and Bulk District.

Preliminary Recommendation: Approval with Conditions

SFPUC PROJECTS AND CONSERVATION MEASURES - Planning Department and San Francisco Public Utilities Commission (SFPUC) staff will make an informational presentation about plans to conserve and recycle water in the SFPUC service area. Staff will also discuss environmental documents on SFPUC projects that will undergo consideration by the Planning Commission in the near term and the longer term studies that will be on-going.

Preliminary Recommendation: Informational presentation, possible action to authorize Commission President to send a proposed letter to the SFPUC

At this time, members of the public may address the Commission on items of interest to the public that are within the subject matter jurisdiction of the Commission except agenda items. Authorization of ERO to Conduct Draft EIR Hearings Near Project Sites- Consider authorizing the Environmental Review Officer, or his designee, to take supplemental public testimony at additional hearings on draft Environmental Impact Reports (EIRs) for projects proposed by the San Francisco Public Utilities Commission (SFPUC) in jurisdictions outside the City and County of San Francisco. The projects and proposed hearing locations include:

  1. San Andreas No. 3 Pipeline Installation (Daly City)
  2. San Joaquin Pipeline System (Modesto and Tracy)
  3. CS/SA Transmission Upgrade (Hillsborough)
  4. Lower Crystal Spring Dam (Hillsborough)
  5. Conjunctive Use Groundwater (Daly City)
  6. Harry Tracy Water Treatment Plant Long Term Improvements (Hillsborough)
  7. Crystal Springs Pipeline No. 2 (Hillsborough)
  8. Seismic Upgrade of Bay Division Pipelines No. 3 and 4 (Fremont)
  9. Alameda Watershed Habitat Conservation Plan (Fremont or Sunol)
  10. San Antonio Backup Pipeline (Fremont or Sunol)
  11. Habitat Reserve Program (Fremont and San Mateo)
  12. Alameda Creek Fisheries Enhancement (Fremont or Sunol)

The public hearings in other jurisdictions would be in addition to, and not in lieu of, this Commission's hearing to take public comment on the draft EIRs for the proposed projects. The Planning Commission may also authorize the Environmental Review Officer, or his designee, to hold additional public hearings, as provided in San Francisco Administrative Code Sections 31.05 and 31.14. Because the projects could affect areas outside the City and County of San Francisco, the Environmental Review Officer recommends holding additional public hearings near the projects site and is requesting authorization from the Planning Commission to do so.

Preliminary Recommendation: Authorize the Environmental Review Officer to conduct additional public hearings on draft EIRs for the SFPUC projects.

San Joaquin Regional Water Quality Improvement Project - unincorporated San Joaquin County: the Tesla Portal site is located at the western terminus of West Vernalis Road, about 7.5 miles south of the City of Tracy, and the Thomas Shaft site is located at the southern terminus of Thomas Shaft Road, south from its intersection with Corral Hollow Road, about 7 miles southwest of the City of TracyCertification of the Final Environmental Impact Report. The San Francisco Public Utilities Commission (SFPUC) proposes the San Joaquin Regional Water Quality Improvement Project to improve water disinfection capabilities at the SFPUC's Tesla Portal site and the Thomas Shaft site, both within unincorporated San Joaquin County. At the Tesla Portal site, the Tesla Treatment Facility is proposed, which entails replacement of the existing Tesla Portal Hypochlorite Station with a new Chemical Process Building and Office/Control Building, and the construction of an ultraviolet (UV) facility, which would disinfect water using a series of UV light arrays. At the Thomas Shaft site, the Lawrence Livermore Water Quality Improvements would upgrade the existing water treatment facility with a UV system. Both facilities are proposed to meet disinfection requirements of the Surface Water Treatment Rule and the Long Term 2 Enhanced Surface Water Treatment Rule.

Preliminary Recommendation: Certify the Environmental Impact Report

Please note: The public hearing on the Draft EIR is closed. The public comment period for the Draft EIR ended on October 8, 2008. The Planning Commission does not conduct public review of Final EIRs. Public comments on the certification may be presented to the Planning Commission during the Public Comment portion of the Commission calendar.

7. 2006.0881E (D. DWYER (415) 575-9031)

420-430 29th Avenue/St. Peter's Church Relocation and Supportive Housing Project - east side of 29th Avenue between Geary Boulevard and Clement Street; Lots 014B and 015 in Assessor's Block 1460 – Certification of the Final Environmental Impact Report. The proposed project includes the demolition of Saint Peter's Episcopal Church, renovation of the existing Parish Hall and Rectory, relocation of the church Sanctuary to the Parish Hall, a lot line adjustment to reconfigure the two lots, and construction of a 20-unit housing development to serve developmentally disabled adults. The 20-unit housing development would replace the Sanctuary with a three-story over partial basement building of 16,915 gross square feet. The existing Sanctuary, built in 1913, is an historic resource. The project site is located in an RH-2 (Residential House, Two-Family) Zoning District and 40-X height and bulk district. The proposed project would require rezoning of the property from RH-2 to RM-1 (Residential, Mixed, Low-Density) Zoning District. The proposed project would also require Conditional Use Authorization for relocation of the church use in an RM-1 Zoning District and a rear yard variance.

Preliminary Recommendation: Certify the Environmental Impact Report

Please note: The public hearing on the Draft EIR is closed. The public comment period for the Draft EIR ended on July 15, 2008. The Planning Commission does not conduct public review of Final EIRs. Public comments on the certification may be presented to the Planning Commission during the Public Comment portion of the Commission calendar.

THE VISITACION VALLEY REDEVELOPMENT PLAN Certification of Final Environmental Impact Report - Consideration and possible action to certify the Final Environmental Impact Report. This is an environmental impact report on the Visitacion Valley Redevelopment Plan. The Redevelopment Plan area has the following general boundaries: Tunnel Avenue to the east; the San Francisco/San Mateo County line to the south; to the west generally by lots fronting the west side of Bayshore Boulevard between Sunnydale Avenue on the south and Blanken to the north and lots fronting the both sides of Leland Avenue, between Bayshore Boulevard and Cora Street to the west. The Visitacion Valley Redevelopment Plan calls for redevelopment of the long-vacant Schlage Lock site into the larger Visitacion Valley neighborhood, creating a transit-oriented mixed use development with new residential units, including affordable units, a mid-sized grocery store, and other neighborhood commercial ground floor retail on the Schlage site. It also includes a number of public improvements, including new neighborhood parks, the extension of the Visitacion Valley street grid throughout the Schlage Lock property, and pedestrian improvements to the circulation network including improvements to Bayshore Blvd. Intersections.

Preliminary Recommendation: Certify the Final Environmental Impact Report

Note: The public review period for the Draft Environmental Impact Report ended at 5:00 pm, July 21, 2008. The Planning Commission does not conduct public review of Final EIRs. Ground Floor Residential Design Guidelines - Resolution to Adopt the Draft Ground Floor Residential Design Guidelines as required by Planning Code Sections 144, 145.1 and 827.Sections 144, 145.1, and 827 of the Planning Code (as amended through the pending Eastern Neighborhoods Code package) require that in RTO, NCT, DTR, and Eastern Neighborhoods Mixed Use (MUO, MUG, MUR, UMU, and SPD) districts all off-street parking located above grade must be set back from all street frontages and lined with  active uses. These Sections state if residential uses are proposed in new construction to satisfy the requirement for  active uses that their design be consistent with the  Ground Floor Residential Design Guidelines as adopted and periodically amended by the Planning Commission. The guidelines in this document supplement the existing design policies and principles in the General Plan and the requirements and standards in the relevant Planning Code sections.

Preliminary Recommendation: Take Discretionary Review and approve the project with modifications.

I. PUBLIC COMMENT

At this time, members of the public may address the Commission on items of interest to the public that are within the subject matter jurisdiction of the Commission except agenda items. With respect to agenda items, your opportunity to address the Commission will be afforded when the item is reached in the meeting with one exception.
