Commission Meeting Procedures

Material submitted by the public for Commission review prior to a scheduled hearing should be received by the Planning Department reception counter at 1650 Mission Street, 4th floor, no later than 5:00 PM the Wednesday (eight days) prior to the scheduled public hearing. Persons unable to attend a hearing may submit written comments regarding a calendared item to: Planning Commission, 1650 Mission Street, Suite 400, San Francisco, CA 94103-2414. Comments received by 11:00 AM on the day of the hearing will be made part of the official record and will be brought to the attention of the Planning Commission at the public hearing. Otherwise, submit material related to a calendared item at the scheduled hearing for distribution. For complete distribution to all Commissioners, necessary staff and case/docket/correspondence files, submit an original plus 10 copies. Pursuant to Government Code Section 65009, if you challenge, in court, (1) the adoption or amendment of a general plan, (2) the adoption or amendment of a zoning ordinance, (3) the adoption or amendment of any regulation attached to a specific plan, (4) the adoption, amendment or modification of a development agreement, or (5) the approval of a variance, conditional-use authorization, or any permit, you may be limited to raising only those issues you or someone else raised at the public hearing described in this notice, or in written correspondence delivered to the Planning Commission, at, or prior to, the public hearing.

Commission action on conditional-uses and reclassification may be appealed to the Board of Supervisors within 30 days. Call (415) 554-5184 for more information. Commission actions after Discretionary Review may be appealed to the Board of Appeals within 15 days of action by the Central Permit Bureau. Call (415) 575-6880 for more information. Zoning Administrator action on a variance application may be appealed to the Board of Appeals within 10 days of issuance of the written decision.

The Commission has instituted a policy that, in most cases, they will not call an item for consideration after 10:00 PM. If an item is scheduled but not called or introduced prior to 10:00 PM, the Commission may continue the matter to the next available hearing. Items listed on this calendar will not be heard before the stated time.

Cell Phone and/or Sound-Producing Electronic Devices Usage at Hearings

Effective January 21, 2001, the Board of Supervisors amended the Sunshine Ordinance by adding the following provision: The ringing of and use of cell phones, pagers and similar sound-producing electronic devices are prohibited at this meeting. Please be advised that the Chair may order the removal from the meeting room of any person(s) responsible for the ringing or use of a cell phone, pager, or other similar sound-producing electronic devices (67A.1 Prohibiting the use of cell phones, pagers and similar sound-producing electronic devices at and during public meetings).

The proposal is to demolish the existing one-story church building (in a converted bank building) and construct a new 3 story building 11,625 square feet in area for the church with 11 off street parking spaces.

2333 BUCHANAN STREET- (a.k.a. 2140 Webster St. and 2340 Clay St.), north side between Buchanan and Webster Streets, Assessor's Block 0613, Lot 029, Block 0628 Lot 013, and Block 0628 Lot 014 - Request for Conditional Use Authorization under Planning Code Sections 303 and 303.4(d)(5) for the California Pacific Medical Center (CPMC) Pacific Campus to modify conditions of a previous PUD authorization for way finding signs that exceed the number and size of signs principally permitted by Section 606(b)(1) in an RM-2 (Residential, Mixed, Moderate Density) District and a 160-F Height and Bulk District.

1145 MARKET STREET- south side between Seventh and Eighth Streets, Lot 044 in Assessor's Block 3702 - Section 309 Determination of Compliance to replace the existing copper cupola roof feature with a glass roof that would increase the height of this element by three feet at the top of this thirteen story office building. The project site is within a C-3-G (Downtown General Commercial) Zoning District and a 120-X Height and Bulk district.

Amendments repealing Planning Code Section 825.1 and amending Planning Code Sections 135, 309.1, 318.3, 809, 825, and 827.Proposed Ordinance [Board File Number 071292]introduced by Supervisor Daly to apply many of the pedestrian-friendly provisions of the Rincon Hill Downtown Mixed Use Zoning District to all Downtown Residential Districts. Specifically, the proposed Ordinance would add design requirements to enhance the pedestrian environment including but not limited to controls for ground floor uses, transparency, wind protection, lighting, and sidewalk treatments, and making environmental findings and findings of consistency with the General Plan and priority policies of Planning Code Section 101.1.

400 DIVISADERO STREET- northeast corner at Oak Street; Lots 17, 18 and 19 in Assessor's Block 1216 - Request for Conditional Use Authorization to allow a temporary parking facility pursuant to Sections 209.7(c), 303(c) and 711.56 of the Planning Code. The site contains the Touchless Car Wash and a Shell service station. A portion of the site is designated for circulation and drying area for the car wash. The proposal is to allow for after-hours (from 7:00 p.m. to 2:00 a.m.) temporary parking of vehicles in the car wash circulation and drying area, in an NC-2 (Small-Scale Neighborhood Commercial) District with a 65-A Height and Bulk District, and an RH-3 (Residential, House, Three-Family) District with a 40-x Height and Bulk District.

First Source Hiring Ordinance- expanding scope of covered permits in Market and Octavia Plan [Board File 080235]On February 12, 2008, Supervisor Mirkarimi introduced an Ordinance amending the San Francisco Administrative Code by amending sections 83.2, 83.4, and 83.6 to: (1) expand the scope of permits that the ordinance applies to in the Market and Octavia Area Plan; (2) place new reporting requirements on the First Source Hiring Administration that include reporting first source statistics on permittees, as defined under the ordinance, and (3) require contractors and permittees to cooperate with reasonable requests for information from the First Source Hiring Administration. The proposed Ordinance is before the Commission so that it may recommend adoption, rejection, or adoption with modifications to the Board of Supervisors.

580 HAYES STREET- north side between Laguna and Octavia Streets, Lot 010 in Assessor's Block 0807 - Request for Conditional Use Authorization. The project requires Conditional Use Authorization for an institutional use above the ground floor, for a non-residential use larger than 3,000 square feet and for development of a lot larger than 10,000 square feet. The site is within the Hayes-Gough Neighborhood Commercial District, and a 50-X Height and Bulk District, but is to be rezoned under the pending Market and Octavia Area Plan Code Amendments to the Hayes-Gough Neighborhood Commercial Transit District and a 55-X Height and Bulk District. The project complies with the pending Code Amendments but does not comply with current zoning. The project proposes to demolish the existing building and construct a mixed use building containing approximately 2,700 square feet of ground floor retail space along Hayes Street, an assisted living facility of approximately 48 units, 42 independent living group housing units for seniors and 17 off-street parking spaces in an underground garage accessed off of Ivy Street. The proposed building would be 5 stories and 55 feet in height over a below grade basement, totaling approximately 63,000 square feet.

Preliminary Recommendation: Adopt a Motion of Intent to adopt a motion approving the project, with conditions, once the Market and Octavia Area Plan Code Amendments become effective.

1000 Mississippi Street (aka 1001 Texas Street)-west side, near the intersection with 25th Street, Lots 015, 016, 037, 038, 039, and 040 in Assessor's Block 4224 - Request for Conditional Use Authorization pursuant to Planning Code Sections 209.1, 295, 303, and 304 to construct a 28-unit Planned Unit Development (PUD) in a RH-3 (Residential, House, Three-Family) Zoning District and a 40-X Height and Bulk designation. The PUD includes 5 residential buildings, 28 off-street parking spaces, and requests exceptions for density, rear yard, open space, exposure, and height.

Preliminary Recommendation: Approval with Conditions

245 HYDE STREET- southwest corner of Eddy Street, Lots 017, 018, and 019 in Assessor's Block 0336 - Request for Conditional Use Authorization to provide no off-street parking where 16 spaces are required. The proposed project is the conversion of an office/retail building to 65 dwelling units and construction of a one-story vertical addition. The interiors of the existing interconnected two-story buildings will be demolished to accommodate the insertion of a third floor within the existing building envelope, for a total of four floors. The project site is within an RC-4 (Residential-Commercial Combined, High-Density) District, the North of Market Residential Special Use District, and an 80-T Height and Bulk District.

Preliminary Recommendation: Approval with Conditions.

245 HYDE STREET- southwest corner of Eddy Street, Lots 017, 018, and 019 in Assessor's Block 0336 - Requests for Variance for a rear yard modification; a dwelling unit exposure variance for the units that will not face Hyde or Eddy Streets; and a usable open space variance. The proposed project is the conversion of an office/retail building to 65 dwelling units and construction of a one-story vertical addition. The interiors of the existing interconnected two-story buildings will be demolished to accommodate the insertion of a third floor within the existing building envelope, for a total of four floors. The project site is within an RC-4 (Residential-Commercial Combined, High-Density) District, the North of Market Residential Special Use District, and an 80-T Height and Bulk District.

It is important to understand that by initiating these changes on April 17th, the Commission will not make any decision or approval regarding the content of the Eastern Neighborhoods proposals. Initiation merely allows the Department to advertise for public hearings expected in mid-May to take public comment on the proposed Eastern Neighborhood Proposals. Discussion of the substance of the Eastern Neighborhoods proposals by the Planning Commission will begin with the first approval hearing, expected in mid-May, 2008.

EASTERN NEIGHBORHOODS PROGRAM – INTENTION TO INITIATE AMENDMENTS TO THE GENERAL PLAN, PLANNING CODE AND ZONING MAP- The Eastern Neighborhoods Program encompasses the entirety or portions of 437 Assessor's Blocks in the following four neighborhoods: Mission (generally bounded by Division Street, Potrero Avenue, Cesar Chavez Street and Guerrero Street), Central Waterfront (generally bounded by 16th Street, the Bay, Islais Creek and Highway 280), East SoMa (generally bounded by portions of Mission Street, Folsom Street, The Embarcadero and 4th Street) and Showplace Square – Potrero Hill (generally bounded by Harrison Street, 7th Street/highway 280, 26th Street and Potrero Avenue). The exact geography of the Eastern Neighborhoods Program, including a list of all affected Assessor's Blocks and Lots, is available at http://en-hearings.sfplanning.org.

a) Consideration of a Resolution of Intention to initiate amendments to the San Francisco General Plan related to the Eastern Neighborhoods Program.

Pursuant to San Francisco Charter Section 4.105, and Planning Code Sec. 340, the Planning Commission will consider adopting a Resolution of Intention to Initiate amendments to the General Plan, including adding four new Area Plans, and making related amendments to the Commerce and Industry Element, Recreation and Open Space Element and the Central Waterfront Area Plan, South of Market Area Plan and Northeastern Waterfront Area Plan as well as the Land Use Index. Proposed amendments to the General Plan and Area Plans can be viewed at http://en-hearings.sfplanning.org.

Preliminary Recommendation: Approve a draft Resolution of Intention to initiate amendments to the General Plan and schedule a public hearing to consider the amendments.

b) Consideration of a Resolution of Intention to initiate amendments to the San Francisco Planning Code related to the Eastern Neighborhood Program

Pursuant to Planning Code Section 302, the Planning Commission will consider a Resolution of Intention to initiate amendments to the Planning Code. The amendments would bring the Planning Code regulations governing the four Eastern Neighborhoods into consistency with the General Plan, as proposed to be amended. The amendments contain proposals for changes to standards from those currently established by the Planning Code, including but not limited to those for land use, height and bulk, building design, density, open space, and parking. Proposed Planning Code text amendments will a) establish 13 new zoning districts; b) amend the South Park District; RTO District, NCT Districts, Downtown Residential Districts, and PDR Districts; and c) make related revisions to the Planning Code necessary to implement the General Plan as proposed to be amended and make related Planning Code Amendments pursuant to the Eastern Neighborhoods Area Plans. Preliminary Recommendation: Approve a draft Resolution of Intention to initiate amendments to the Planning Code and schedule a public hearing to consider the amendments.

c) Consideration of a Resolution of Intention to initiate amendments to the Zoning Map of the San Francisco Planning Code related to the Eastern Neighborhoods Program

Pursuant to Planning Code Section 302, the Planning Commission will consider a Resolution of Intention to initiate amendments to the Zoning Map by reclassifying property, including amendments to the Zoning Map of the City and County of San Francisco. Proposed Planning Code map amendments will a) update height and bulk districts, b) apply the RTO District and PDR-2 Districts in the Eastern Neighborhoods, and c) establish 13 new zoning districts. Proposed amendments to the Zoning Map can be viewed at http://en-hearings.sfplanning.org. These amendments include:

  1. · Applying the South Beach Downtown Residential (SB-DTR) District to the South Beach neighborhood, currently zoned M-1 and M-2.
  2. · Applying the Mission Street Neighborhood Commercial Transit District (Mission Street NCT) to the existing NC-3 District along the Mission Street corridor.
  3. · Applying the Valencia Street Neighborhood Commercial Transit District (Valencia Street NCT) along the existing Valencia Street Neighborhood Commercial District along the Valencia Street corridor.
  4. · Applying the Small Scale Neighborhood Commercial Transit District (NCT-2) in portions of Central Waterfront currently zoned NC-2.
  5. · Applying the SoMa Neighborhood Commercial Transit District (SoMa NCT) along portions of 6th Street and Folsom Street corridors in the South of Market that are currently zoned RSD and SLR.
  6. · Applying the Mixed Use-General (MUG) District to the parcels in East SoMa currently zoned SLR.
  7. · Applying the Mixed Use-Residential (MUR) District to the parcels in of East SoMa currently zoned RSD.
  8. · Applying the Mixed Use-Office (MUO) District to parcels in East SoMa currently zoned SSO.
  9. · Applying the Urban Mixed Use (UMU) District to portions of the Mission, Showplace Square, and Central Waterfront currently zoned C-M, M-1, and M-2.
  10. · Applying the PDR-1-General (PDR-1-G) District in portions of the Mission and Showplace Square currently zoned C-M, M-1, and M-2
  11. · Applying the PDR-1-Design (PDR-1-D) District in portions of Showplace Square currently zoned M-1 and M-2
  12. · Applying the PDR-2 District in portions of the Central Waterfront currently zoned M-2
  13. · Applying the Life Science and Medical Special Use District to portions of the Central Waterfront currently zoned M-2.
  14. · Applying the Innovative Industries Incubator Special Use District to portions of Showplace Square currently zoned M-2.

Preliminary Recommendation: Approve a draft Resolution of Intention to initiate amendments to the Zoning Map and schedule a public hearing to consider the amendments.

G. PUBLIC COMMENT

At this time, members of the public may address the Commission on items of interest to the public that are within the subject matter jurisdiction of the Commission except agenda items. With respect to agenda items, your opportunity to address the Commission will be afforded when the item is reached in the meeting with one exception. When the agenda item has already been reviewed in a public hearing at which members of the public were allowed to testify and the Commission has closed the public hearing, your opportunity to address the Commission must be exercised during the Public Comment portion of the Calendar. Each member of the public may address the Commission for up to three minutes.

The Brown Act forbids a commission from taking action or discussing any item not appearing on the posted agenda, including those items raised at public comment. In response to public comment, the commission is limited to:

(1) responding to statements made or questions posed by members of the public; or

(2) requesting staff to report back on a matter at a subsequent meeting; or
