Ordinance amending the San Francisco Planning Code by adding Section 785 to establish the Mission/Bernal Formula Retail Restricted Use Subdistrict and to amend Section 703.3 to prohibit formula retail uses in the Mission/Bernal Formula Retail Restricted Use Subdistrict [Board File No. 07-1561]. 230 Jones Street - Request for Conditional Use Authorization to legalize an existing institutional use (City Impact Ministries) currently occupying and utilizing the entire subject building. Interior tenant improvements would occur throughout the subject building to bring the building into compliance with applicable City codes. No physical expansion of the existing building is proposed. This site is within a RC-4 (Residential-Commercial Combined, High Density) District, the North of Market Residential Special Use District, Subarea No. 1, and an 80-120-T Height and Bulk District.

The Project site is located within an RH-2 (Residential, House, Two-Family) and an NC-2 (Neighborhood Commercial, Small-Scale) Zoning District with a 40-X Height and Bulk designation. The Zoning Administrator will consider the variance application concurrently with the Planning Commission.

5. Director's Announcements

6. Review of Past Week's Events at the Board of Supervisors and Board of Appeals

Land Use:

  • First Source hiring Ordinance for market & Octavia – You heard this on April 17th. You recommended approval. The ordinance would amend the Admin. Code to expand the scope of permits subject to the ordinance within the M&O Plan Area; place new reporting requirements on the First Source hiring Administration; and would require contractors to cooperate with reasonable requests for information for the First Source Hiring Admin. This week the Committee recommended approval to the full Board.
  • Kaiser Rezoning – You heard this on May 15th. You approved the rezoning and the associated entitlements that would reclassify a parcel from NC-2 to MC-3 to allow a six-story, 75,000 square foot clinic and medical office building for Kaiser Permanente. The Committee heard this and continued it so the stakeholders could finalize arrangements for the replacement housing triggered by Redevelopment Agency controls. The item was continued to the call of the Chair
  • Affordable housing Preference for Certificate Holders – you heard this as two proposals on July 17th One was from Mayor Newsom and one from Supervisor Mirkarimi. You recommended that the Board work with the Mayor's Office of Housing and the Redevelopment Agency and choose the program that best serves the city. Since then, the Mayor and the Supervisor have collaborated and submitted a combined ordinance to the Committee. The combined ordinance would require that all on or off-side affordable housing units for both large commercial and residential projects be first offered to individuals who hold certificates of preference. The Committee recommended approval to the full Board.
  • Status of Eastern Neighborhoods (EN) – Last week you approved the legislation associated with the EN program. This week, Director Rahaim acknowledged that accomplishment before the Land Use Committee. The Director presented a schedule for transmitting all documents to the Board while they are in their summer recess. The Committee is expected to begin the Board adoption hearings on September 15th. No action was taken on this item this week.

Full Board:

  • The Board approved reappointment of Commissioners Antonini and Miguel
  • Hope SF – You heard this on June 12th to establish the HOPE SF Hunters View Special Use District and related amendments. This project will increase the housing on the parcels by about 533 mixed-income units. It will replace existing HA units in a phased manner to avoid displacement while adding market rate units to help subsidize new affordable housing. Since you heard this it has been amended to require that the existing bedroom mix re reconstituted in the future program. The Committee then sent the item out as a  committee report so that it could be heard the next day at the Full Board. The Board then passed the item on its second and final reading.
  • Third and Mendell Rezoning – This rezoning would correct an error from 1995. In 1995 all parcels on 3rd Street in this area were rezoned from 105 feet to 55 feet except six (6) parcels which have a Mendell Street address but are effectively on 3rd Street. You approved this rezoning on July 10. This week the Full Board passed the item on its second and final read.
  • Off-site Inclusionary Affordable Housing Requirements – This legislation sponsored by Supervisor Sandoval would amend Planning Code Section 315.5 to allow 25% of off-site affordable units to be built outside of the currently required one-mile radius from the market rate project. You heard this item on May 29 and voted that the Board not approve this ordinance with Commissioner Antonini dissenting. The Board then passed the item on its second and final reading.

Appeals:

  • This week the Board heard appeals of 2 condo-map designations. The Planning Department reviews these applications for conformance with the General Plan. The first appeal concerned the Fillmore Center in the Redevelopment Agencies WA-A2 Plan area. The application was to convert 655 rental units into condos. The Department found this application inconsistent with the General Plan because it would convert a large number of generally occupied rental units into condos. The Board upheld the Department's action.
  • The other condo-map appeal concerned an application to convert 3 units at 628 Stiener Street. This application was denied as the address had a Planning Code violation that had not yet been addressed. The Department stated we would support the application upon demonstration that the violation had been cleared. The Board passed a motion of approval with the stipulation that the owner demonstrate the violation had been abated.
  • Appeal of 300 Grant Avenue. The proposal would demolish two commercial buildings, construct a new, 10-story, mixed-use building containing approximately 45 dwelling units and retail within the Kearny-Market-Mason-Sutter Conservation District. This week the Board upheld the mitigated negative declaration for the project.

BICYCLE PLAN ENVIRONMENTAL IMPACT REPORT - Informational item to discuss current status of environmental review for the Bicycle Plan - The director will lead this discussion on a monthly basis until the certification of the Bicycle Plan EIR. The Municipal Transportation Agency Board is also holding concurrent monthly briefings on the status of the Bicycle Plan.

166-178 Townsend Street - Certification of Final Environmental Impact Report. The 22,000 square foot project site is located at 178 Townsend Street, on the corner of Townsend Street and Clarence Place between Second Street and Third Street (Assessor's Block 3788, Lot 012). The site is zoned SLI (Service/Light Industrial), is in a 50-X Height and Bulk District, and is occupied by the California Electric Light Company Station B building, a Contributory Building within the South End Historic District. The proposed project involves conversion of the building from its current use as a valet parking garage to a mix of ground-floor retail and up to 85 housing units, with accessory off-street parking for the residential uses. The proposed uses would be housed in the existing building and a vertical addition, and would occupy 96,350 square feet (sf) of floor area, including 71,500 sf in residential uses 1,050 sf in retail uses, and 13,200 sf of parking. The proposed vertical addition would be set back 40 feet from Townsend Street and would rise above the existing 23-to 42-foot tall roofline to a height of 50 feet. The proposed project also includes a one-level underground parking garage with 74 parking spaces in two-car stackers accessed from Clarence Place.

Preliminary Recommendation: Certify the Final Environmental Impact Report

Note: The public review period for the Draft Environmental Impact Report ended at 5:00 pm, February 5, 2008. The Planning Commission does not conduct public review of Final EIRs. Public comments on the certification may be presented to the Planning Commission during the Public Comment portion of the Commission calendar.

2225-2255 3RD STREET - Certification of the Final Environmental Impact Report for the proposed construction of three buildings above a below-grade parking podium. The buildings would include about 179 residential units, 5,262 square feet of restaurant space, 11,434 square feet of retail, 2,393 square feet of day-care space, 157 parking spaces, 50 bicycle parking spaces, and 2 off-street loading spaces. The structures would total about 242,185 square feet and range in height from 35 to 65 feet tall. The project would preserve and renovate two existing historic buildings. The project site (Assessor's Block 4058, Lot 10) is located between 19th and 20th Streets in an M-2 (Heavy Industrial) District and a 50-X Height and Bulk District.

NOTE: The public hearing on the Draft EIR is closed. The public comment period for the Draft EIR ended on May 21, 2007. The Planning Commission does not conduct public review of Final EIRs. Public comments on the certification may be presented to the Planning Commission during the Public Comment portion of the Commission calendar.
