PUBLIC COMMENT

Charles Chase: He thinks that 807 Franklin Street is being neglected because the property is deteriorating. He requested the Landmarks Board to request the planning staff and the Building Inspection to investigate the issues to find out what's going on with the property.

REPORTS

1. STAFF REPORT AND ANNOUNCEMENTS

Mark Luellen, Preservation Coordinator:

iThe disapproved C of A for 1306-1310 McAllister Street was heard before the Planning Commission of March 15, 2007, the disapproval was overturned by a vote of 4-3 by the Planning Commission.

iThe amendment to Article 10 to include language regarding the designation of privately owned interiors was heard at the Land Use Committee and Economic Development Committee on March 19th; it was recommended for approval and will be forwarded to the Board of Supervisors.

iThe Mills Act application for 1080 Haight Street was introduced to the Board of Supervisor on March 20th. The application will be forward to the Land Use and Economic Development Committee (a hearing date as not yet been determined).

iOn March 20th, the Planning Department's Cat-Ex for 869 Northpoint Street was overturned by the Board of Supervisors by a vote of 6-4. The Board concurred with appellant that it is a potential historic district. It was supported by a letter from Kate Richardson, Park Superintendent of S.F. Maritime Historic Park.

iThe Cat-Ex appeal for 2130 Golden Gate (aka 350 Masonic) was rescheduled to be heard before the Board of Supervisors on March 27th.

iThe Review and Comment of the DEIR for Market/Octavia is scheduled to be heard before the Planning Commission on March 22, 2007.

iOn April 5th, the Mills Act application for 1735 Frankin will be heard at the Planning Commission.

iThe Review and Comment for 55 Laguna DEIR as been continued to April 19th before the Planning Commission.

iThe Landmarks Preservation Advisory Board hearing scheduled for May 2, 2007 will be cancelled to accommodate the Planning Department's move. The new address will be 1650 Mission Street.

iThe Planning Commission's regular hearing schedule for May 3rd has been cancelled to accommodate the Department's move. The Planning Commission will hold a special meeting on May 31, 2007 to accommodate cases as necessary.

iArchitectural Heritage will be holding a lecture entitled  Revisiting the Treasure Island fair on Thursday, April 5th at 6:30 pm at the Hass-Lilenthal Ballroom.

iThe Sunset Branch Library will be holding it's Grand Reopening on March 31st at 1305 18th Avenue @ 1:00 p.m.

2. PRESIDENT'S REPORT AND ANNOUNCEMENTS

She and others attended a meeting regarding the use of transfer development rights (TDR's) coming out of Civic Center and into the open market and the use of TDR's to fund projects in the Civic Center. It was a great discussion and she requested to have the full legislation for the Board members at their next hearing.

Street

While attending the Planning Commission hearing the city attorney asked her to inform the Landmarks Board to vote on a designee who will represent the Landmarks Board on items of interest at Commission hearings.

President Maley nominated herself to attend the Planning Commission hearing on March 22, 2007. The vote was unanimous.

3. MATTERS OF THE BOARD

Street

She represented herself at the Planning Commission hearing regarding the disapproved C of A for 1306-1310 McAllister Street. She stated that the Planning Commission approved the project without reviewing the design.

Martinez

He requested the status on the comments made by the Landmarks members regarding CEQA? Questioned if there was any process on establishing a working group to discuss the Secretary of Interior Standards and how they apply. Supervisor's Peskin and Dufty have talked about an event announcing/celebrating their commitment to funding the citywide survey on an on-going basis, and Martinez requested the Landmarks Board to be sponsors for this event.

Hasz

He asked if the Landmarks Board needs to send a letter of clarification when a case is overturned by the Planning Commission.

4. LANDMARKS WORK PROGRAM 2005-2007 UPDATE

President Maley – Progress has been made on 1620 Montgomery Street.

5. HISTORIC PRESEVATION FUND COMMITTEE UPDATE

The planning staff presented information about the current work program in terms of the surveys and budget. Also discussed an application for funding and some of the problems with it. The committee is working with several grant applications at this time.

Board Action

It was moved by Board Member Street (seconded by Martinez) to adopt the draft action minutes. The vote was unanimous.

CERTIFICATE OF APPROPRIATENESS

7. 2007.0190A (T. FRYE: 415/575-6822)

325 LEXINGTON STREET, Assessor's Block 3609; Lot 075. A Request for a Certificate of Appropriateness to replace the non-historic casement windows on the front of the building, remove a non-historic addition at the second-floor, create new window openings on the south elevation, and install a pass-through door at the side of the building. The subject property is a  potentially compatible structure within the Liberty-Hill Historic District. It is within the RH-2 (Residential/House) use district and a 50-X Height and Bulk District.

Preliminary Recommendation: Approval with Conditions

8. (V. WISE: 415/558-5955)

255 Seventh Street (Westbrook Plaza): Public Hearing to assist the Landmarks Preservation Advisory Board to prepare a comment letter on the Draft Environmental Impact Report. The project site is located at 255 Seventh Street (Assessor's Block 3731, Lots 126 and 154) mid-block between Howard and Folsom Streets in the South of Market neighborhood. The approximately 23,655-square-foot, T-shaped project site fronts the east side of Seventh Street and the west side of Moss Street. The existing site includes a one-story commercial building totaling about 2,000 square feet and a one-story building totaling about 960 square feet. The rest of the lot is occupied by a surface parking lot. The proposed project would demolish both structures and eliminate the surface parking lot. The proposed project would result in the construction of two new buildings and a subsurface parking lot with 45 off-street parking spaces. A five-story, 50-foot building with three levels of residential above a two-level health center would front Seventh Street. A four-story, 40-foot residential building would front Moss Street. The Seventh Street Building would contain an approximately 20,000-square-foot out-patient South of Market Health Center (SMHC) and 30 affordable dwelling units. The Moss Street Building would have 19 affordable dwelling units. The project site is within the SLR (Service/Light Industrial Mixed Use) and RED (Residential Enclave) zoning districts and the 50-X/40-X height and bulk districts. The project site is in the Eastern Neighborhoods Plan Area and is subject to the Housing/Mixed Use Guidelines.

NOTE: The Draft Environmental Impact Report (SCH No. 2006092050) was published on February 24, 2007. The Draft EIR identifies the following impacts as significant and unavoidable: Land Use: the proposed project would contribute to the cumulative impact of anticipated future loss of Production, Distribution and Repair ( PDR ) building space and land, and potentially to a concomitant loss of PDR businesses and jobs; and Historic Resources: one of the buildings on the project site is considered a historical resource under CEQA as a contributing structure to a potential historic district in the South of Market neighborhood. The proposed project would result in the demolition of the historical resource and therefore, would have a significant and unavoidable impact and contribute to a cumulative effect on a potential historic district. The Planning Commission will hold a public hearing to receive comments on the Draft EIR on April 5, 2007. This hearing is intended to assist the Landmarks Board such that the Board may prepare written comments on the Draft EIR to submit to the Planning Department. Written comments on the Draft EIR will be accepted at the Planning Department until 5:00 p.m. on Tuesday, April 9, 2007.

It was moved by Board Member Hasz (seconded by Damkroger) to accept the recusal of Board Member Street from this item. The vote was unanimous.

It was moved by Board Member Damkroger (seconded by Chan) to approve of preparing a comment letter on the Draft Environmental Impact Report. The vote was unanimous.

BOARD COMMENTS

Board members are concerned with the loss of building being impact. Suggested adding language to the guidelines regarding analyzing the impact to the district. In the DEIR clarification is needed regarding the partial preservation alternative. The Board feels that the property is significant. Questioned if there was a salvage program. Believe the city is doing the right thing with the EIR by taking the conservative approach that there is an impact with the loss of a single building. Recommended establishing a salvage program. A Board member regrets losing this building as a contributor. Would like to see a creative approach with the development community to help fund a survey or help nominate a district. Suggested a discussion on  how to go forward with an analysis when you have a potential contributor to a potential district ?
