PUBLIC COMMENT

Gee Gee Platt: She informed the Landmarks Board that members of the preservation community have appealed the categorical exemption for 350 Masonic also known as 2130 Golden Gate Ave. They are concerned that insufficient research has been undertaken to make a qualified professional determination whether the proposed will have an impact one or more historic resources. The appeal hearing has been scheduled for Tuesday, February 13, 2007, at 4:00 p.m. She provided the Landmarks Board with documentation that she submitted in support of the appeal.

Edward Suyarsui: He has concerns with the transferable development rights (TDR). He was told that the city was developing its own inventory of development rights based on on publicly owned buildings. Currently publicly owned buildings are restricted from being able to sell their transferable development rights. He believes that flooding the market with 1.2 million sq. feet of publicly owned development rights would undermine a program that has worked successfully San Francisco for the past 20 years. He encouraged the Landmarks Board to investigate this measure and ask that further thoughtful consideration be given to how the city may achieve its goals of raising revenue while at the same time not undermining the transferable development process which has been San Francisco's most valuable preservation tool.

REPORTS

1. STAFF REPORT AND ANNOUNCEMENTS

Mark Luellen, Preservation Coordinator:

iThe Mission High School Landmark designation and the amendment to Article 10, which would allow additional time for review of landmark designations for the Landmarks Board and the Planning Commission, received its second reading before the Board of Supervisor on January 30, 2007.

iThe revised Mills Act Criteria that was reviewed by the Landmarks Board last September was scheduled before the Rules Committee on January 25th but was continued to an unspecified date.

iThe amendment to Article 10 to include language regarding the designation of privately owned interiors that the Board will hear today has been scheduled before the Planning Commission on March 1, 2007. Commissioner Suguya would like a member of the Board to be present as with all Landmark cases that are before the Landmarks Advisory Board.

iThe Board of the California Cultural and Historical Endowment will meet on February 15th at 10:00 a.m. at the Hiram Johnson State Building, 455 Golden Gate Avenue, in room 225. There will be reviewing grant proposals for the Mexican Museum and the Angel Island Immigration Foundation.

iOn February 10th the West Portal Branch Library @ 190 Lenox Way will be holding it's grand re-opening from 1:00 to 4:00 p.m. The Mayor, Supervisor Elbernd and the City Librarian will also be there. There will be refreshments and entertainment.

iThe California Preservation Foundation will be held in Hollywood on May 3rd thru 6th, registration should begin within the next week.

2. PRESIDENT'S REPORT AND ANNOUNCEMENTS

She requested to agendize a discussion regarding 311 issues and the CEQA review procedures. The discussion will be regarding the potential conflict between 311 issues and the CEQA guidelines and to respond to Director Macris's letter regarding the procedures and what the Landmarks Board can do in the immediate future.

She requested the status/update of the Movie Theaters Context Statement.

3. MATTERS OF THE BOARD

Karl Hasz:

iRequested more information on the transferable development rights. He stated that there is a high value per square foot in the public sector and is concerned about flooding the market with public square footage.

Johanna Street

i Asked if funds were available to purchase a new tape recorder machine. The recorder the department uses now is of poor re-recording quality. She requested an update on the Mills Act and stated that she would like to start public outreach and get the landmark owners information about the Mills Act.

Robert Cherny:

i Thanked the staff for sending him a  Get Well card. He was disappointed to read in the newspaper that the Mission Armory had been sold. He asked if staff could contact the new owners of the Mission Armory to inquiry about their intention for the building, so that the building won't continued to deteriorate.

Alan Martinez:

i Encouraged everyone to review and make their own comments regarding the detailed response to the Landmarks Advisory Board letter regarding the Market & Octavia Plan which is posted on the Planning Department's website. The Planning Commission will be discussing the proposal for the Market & Octavia Plan at their hearing schedule for tomorrow (2/8/07).

Courtney Damkroger:

i Would like for the Mills Act proposal to come back before the Landmarks Board in the future. She would like to review the current draft of the proposal and consider the public concerns are.

Bridget Maley:

i Confirmed that the DEIR for 55 Laguna Mixed Use Project and the Historic Resource Evaluation Report will be heard at the next hearing of the Landmarks Board.

4. LANDMARKS WORK PROGRAM 2005-2007 UPDATE

The Tallant Flat has submitted more information and a meeting will be schedule. Board Member Street offered help with ParkMerced project.

5. HISTORIC PRESERVATION FUND UPDATE

The committee is working with four proposals: the Sunset, guidelines for re-use of warehouse and commercial buildings in SOMA, African American History and the Tenderloin historic district to create a successful development/project.

It was moved by Board Member Street (seconded by Chan) to adopt the draft action minutes with corrections (changed: Talland to Tallant and add was). Board Members Cherny and Dearman were absent and could not vote of this item.

7. 2007.0061T (S. MIDDLEBROOK: 415/558-6372)

The proposed Ordinance is before the Landmarks Board so that it may recommend adoption, rejection, or adoption with modifications to the Planning Commission. Referral from the Board of Supervisors under Planning Code Section 032(b) requesting review of a proposed text change and amendments to Planning Code Sections 1004, 1005, 1006.7. The ordinance was introduced by Supervisor Jake McGoldrick to provide for review of proposed changes to interior architectural features of privately-owned landmark buildings where such features are in areas of the landmark that are generally accessible to members of the public; and making findings, including environmental findings and findings of consistency with the priority policies of Planning Code Section 101.1 and the General Plan.

It was moved by Board Member Damkroger (seconded by Street) to recommend adoption with modifications to the proposed resolution. The Landmarks Board recommended the following changes: change to word  customarily to  historically (buildings that or/have historically been publicly accessible) (located in paragraph # 7 in the resolution);  major to  significant (page #3-items 1 & 2). The vote was unanimous.

340-370 VALENCIA STREET, Valencia Street Gardens Public Housing Project

The Memorandum of Agreement (MOA) between the City and County of San Francisco, Mayors Office of Housing and the California State Historic Preservation Officer regarding the demolition and reconstruction of Valencia Gardens Public Housing Project stipulated that a publicly accessible interpretive display area be developed. The MOA requires that the Landmarks Board review and approve the interpretive display prior to the issuance of a final certificate of occupancy for the project.

It was moved by Board Member Hasz (seconded by Chan) to accept the recusal of Board Member Street from this item.

The Board members suggested sharp crisp statements, were concerned with the timeline, recommended stronger historic photographs, were concerned with the deletion of negative comments (suggested adding the oral history for the negative statements), suggested including a statement regarding William Wurster and Thomas Church, and suggested lowering the display so it may be accessible to children and the disabled. Recommended other changes within the historical facts/timeline and editorial. This item will be re-agendized for approval by the Landmarks Board at the February 21st hearing. The vote was unanimous.

2226 CALIFORNIA STREET, north side of California Street between Buchanan and Webster Streets in Assessor's Block 637, Lot 040. Request for Certificate of Appropriateness to install a new garage, construct a horizontal addition at the rear façade, install a dormer window on the east roof and a skylight on the west roof, alter two window openings on the western façade, and remove & rebuild chimneys. 2226 California Street is San Francisco Individual Landmark No. 168 and was constructed in 1885 in the Queen Anne-style. It is located within an RH-2 (Residential, House, Two-Family) Zoning District and 40-X Height and Bulk District.

It was moved by Board Member Martinez (seconded by Dearman) to approve the Certificate of Appropriateness with the following changes: Remove Bullet #3 - The Board feels that it does not meet Standard #2 of the Secretary of Interior Standards suggested more compatible material to be used like stone or concrete, and specified that the garage width should be 8 ft. and the height should not be no more than 7 ft. The Board members felt that the rusticated retaining wall was a character-defining feature of the Landmark and that a minimum should be removed for the garage. The Board members would not encourage garages in historic buildings. The vote was unanimous.

Request for Certificate of Appropriateness to install a disabled entrance at the western side of the front facade. 2135 Sutter Street is San Francisco Individual Landmark No. 202 and was constructed in 1905 & 1906-07 in the Jacobean phase of Medieval Revival style. It is located within an NC-2 (Small-Scale Neighborhood Commercial) Zoning District and 50-X Height and Bulk District.

Constructed in 1902, 1480-1484 McAllister Street is a Edwardian-style building in the Alamo Square Historic District. It is located within an RM-1 (Residential, Mixed, Moderate Density) Zoning District and 40-X Height and Bulk District.

This item will be heard concurrent with a request for consideration of a Mills Act Property Contract.

The subject building is San Francisco Landmark No. 126 ("The Bransten House"), is listed in the City's 1976 Architectural Survey and in Here Today Page 39 and is located within an RH-2 (Residential, House, Two-Family) District and a 40-X Height and Bulk District.

The motion passes 5-2.
