            President Kelley and members of the Board thanked Mr. Badiner for the presentation.

 

2.         STAFF REPORT AND ANNOUNCEMENTS

Coordinator:

i        Informed the Board that the Statement of Economic Interest forms were in their correspondence folders.

i        Updated Preservation Bulletins Nos. 9, 15 and 21 are in their correspondence folders.

i        CEQA and Historic Resources Procedures are scheduled to be presented before the Planning Commission on February 5, 2004.

i        The Presidio and Sunset Carnegie Branch Libraries and the Names Project landmark designations were before the Planning Commission on January 15, 2004.  The designations will now be sent to the Board of Supervisors for consideration.

i        The CaliforniaPreservation Foundation Annual Conference is being held in San Franciscoon April 28 – May 1, 2004.

Tim Kelley:

                                                                        i        In reference to a news article on the Jewish Museum, President Kelley asked staff to report back on the status of Jewish Museum program at the next hearing.

                        1 SOUTH PARK, south corner of 2nd Street and South Park, Assessor’s Block 3775, Lot 7.  Built in 1913, the Tobacco Company of California was originally used as a tobacco processing and warehouse building, and is currently vacant. The property is a contributory structure within the South End Historic District, is within an SSO (Service / Secondary Office) District, and a 40-X Height and Bulk District.  Request for the Architectural Review Committee comments on a proposal to convert the industrial building into 35 dwelling units with ground floor retail.

i        Major concerns regarding the infill of the railroad spur of the space along 2nd Street

i        Varying opinions on how this infill should be designed.

i        Suggested to completely infill the space.

i        Suggested exploring a partial infill scenario with a curved glass wall at the north end.

i        It was clearly stated that the glass curtain wall should be adequately spaced from the existing arcade walls so that they would not be damaged by the insertion of the new structure and to ensure that the existing, open volume could be readily discerned.

i        Suggested the architect work with the contractors and window manufacturers.

3301 LYON STREET, Palace of Fine Arts, between Bay and Jefferson Streets. Assessor’s Block 916, Lot 2.  The Palace of Fine Arts was originally built in 1915 and reconstructed in permanent materials in 1964, to the design of Bernard Maybeck. The property is zoned P (Public Use) District and is in an OS (Open Space) Height and Bulk District. The State Historic Preservation Office is seeking the Landmarks Preservation Advisory Board’s comments on a proposed nomination to the National Register of Historic Places as part of San Francisco’s role as a Certified Local Government.  (Continued from January 21, 2004 Hearing.)

                7.       NATIONAL REGISTER NOMINATION                (M. LUELLEN: 415/558-6478)

735 MARKET STREET, between 3rd and 4th Streets.  Assessor’s Block 3706, Lot 61. The subject six-story commercial building was designed by turn-of-the century San Francisco architect, Willis Polk and constructed in 1908.  The property is zoned C-3-R (Downtown Retail) District and is in a 120-X Height and Bulk District.   The State Historic Preservation Office is seeking the Landmarks Preservation Advisory Board’s comments on a proposed nomination to the National Register of Historic Places as part of San Francisco’s role as a Certified Local Government.

245 VALLEJO STREET, on the south side of Vallejo Street between Sansome and Battery Streets.  Assessor’s Block 0142, Lot 008.  The subject property is a two-story; commercial building that was constructed in circa 1900 and is a contributory building within the Northeast Waterfront Historic District.  It is zoned C-2 (Community Business) District and in a 84-E Height and Bulk District. Request for a Certificate of Appropriateness to replace existing ground floor storefront windows, expose the natural brick, install new skylights, and restore windows at the building’s rear.

Preliminary Recommendation:  Approval with conditions.

Action:            It was moved by Member Cherny (seconded by Shatara) to recommend approval of the Certificate of Appropriateness with conditions based on Staff Findings.  The vote was unanimous.

                        2550 MISSION STREET, The New Mission Theater, west side between 21st  and 22nd  Streets.  Assessor's 3616, Lot 7.  Constructed in 1916, and then altered in 1932, this building was originally used as a movie palace and served that purpose until 1993; it was then used as a furniture retail store, but is currently vacant.  The subject property is zoned NC-3 (Moderate-Scale, Neighborhood Commercial) District and is in a 50-X/65-B Height and Bulk District.  Request for the Landmarks Preservation Advisory Board recommendation to the Planning Commission on the proposed landmark designation, which was initiated by the Board of Supervisors on December 9, 2003, as Landmark No. 245.

Preliminary Recommendation:  Adopt resolution supporting landmark designation

Board Comments

and Actions:

i        After public comment, Member Samuels made a motion (seconded by Skrondal) to adopt the resolution based on Staff’s recommendation.  President Kelley wanted to suggest adding an amendment to the motion, recognizing the delicacy of the situation and recommending that final action be postponed until the questions of ownership and the intent for the building can be determined.  The maker of the motion did not want to accept the amendment.  The vote was +4 –2.  The MOTION FAILED.

i        Member Shatara made a motion (seconded by Finwall) to adopt the resolution based on Staff’s recommendation with the amendment made by President Kelley as follows:  recognizing the delicacy of the situation and recommending that final action be postponed until the questions of ownership and the intent for the building can be determined.  The vote was +5 –1.  The MOTION PASSED.

690 MARKET STREET, north side at northeast corner of Kearny and Geary Streets. Assessor's Block 311, Lot 6. Request for recommendation to the Planning Commission for approval of a conditional designation as San Francisco Landmark No. 243, and a recommendation to the Planning Commission for conditional approval of a Mills Act Contract for the subject sixteen-story, brick, sandstone and terracotta office building, which is in the C-3-O Zoning District and a 250-S Height and Bulk District.

 

The proposal is to:

 

1)         Seismically upgrade the subject 16-story office building (The Old Chronicle Building), which would include infilling a large light well at the rear of the building that is not visible from any public right-of-way;

2)         Restore the historic building façade by removing a non-historic metal, glass and marble cladding system installed in 1962 and rehabilitation/restoring/ reconstructing intact, damaged and missing historic façade features;

3)         Construct an eight-story vertical addition that will result in a building height of approximately 312 feet;

4)         Convert the existing office building use to a mixed-use project that would have at least 40, but up to 64 residential dwelling units, at least 49, but up to 73 hotel time-share units (for a total 113 hotel and residential unit mix), approximately 6,500 square feet of ground level retail space, replacing an existing retail bank, and creating a sub grade parking structure, that given the irregular floor plate shape and placement of support columns would yield a maximum of 29 independently-accessible parking spaces and two loading spaces on the project site with the capability of providing up to 100 valet and vehicle-stacking spaces in place of the 31 independent spaces.  The new parking facility would be accessed through an existing sub grade garage facility at the adjacent 88 Kearny Street property, thereby not requiring a garage entrance at the ground level of the subject 690 Market Street property;

5)         The Project Sponsors are proposing to meet the Below Market Rate (BMR) housing requirement by constructing the required BMR units off-site at 938 Market Street, a companion project that is also seeking (2003.0587HXVLU);

6)         The Project Sponsors are seeking to avail themselves of the Mills Act, which allows local governments to grant property tax relief benefits in exchange for the guaranteed preservation of a historic property.  In order to qualify under the San Francisco Administrative Code, the property must either be designated as a San Francisco Landmark or listed separately on the National Register.  As neither condition is the case with the subject property, the project sponsor is seeking conditional San Francisco landmark status.  The proposed Landmark Designation would become final upon the completion of the proposed project consistent with the Rehabilitation Program set forth by the proposed Mills Act contract.

 

The Landmarks Preservation Advisory Board will consider the following three actions:

 

1.         Adoption of a resolution with findings related to landmark initiation and a recommendation of approval of a conditional landmark designation of the subject property, contingent upon the successful restoration of the historic façade to the Planning Commission.

2.         Adoption of a resolution with findings regarding the consistency of a proposed eight-story addition to the subject property with the Secretary of the Interior's Standards for Rehabilitation of Historic Structures to the Planning Commission.

3.         Adoption of a resolution with findings recommending the conditional approval of the Mills Act Historical Property agreement, rehabilitation program and maintenance for the subject property to the Planning Commission.

                                                i        After hearing public comments, the Board required revisions to statements contained in the draft Landmark Designation Report.

                                                i        The Board required the addition of a section to the Landmark Designation Report addressing labor history associated with the subject building.

                                                i        The Board agreed and voted to continue the item to the February 18, 2004Landmarks Board Hearing.
