§Announced that several members of the Planning Staff will be attending the California Preservation Foundation Conference in San Diego, May 17-20.

3. PRESIDENT'S REPORT AND ANNOUNCEMENTS

President Kelley:

i Briefed Landmarks Board members and members of the public on a discussion he had with the Friends of 1800 Market Street Board President regarding ornament question.

i After Member Finwall asked about an article in the newspaper regarding the libraries, President Kelley informed the Board and members of the public that he had presented the potential nomination for the Carnegie Libraries to the Library Commission. He stated that the reception from the Library Commission was fairly positive; they had a few qualms about how much this landmarking will restrict their ability to alter the building(s). A meeting is scheduled with Planning Staff, members of the Library Commission and himself to discuss their concerns. He?s confident that when the nomination for the seven Carnegie Libraries are brought forward, they will have the support of the Library Commission.

i Gave an update on the potential Muni nominations (Laguna Honda Muni Station and Muni Car No. 1).

4. MATTERS OF THE BOARD

iAsked about the status of legislation regarding religious properties (AB133).

iAsked staff to look into getting details on legislation at the federal level regarding religious, land use and institutional persons act, which deals with religious properties and restrictions on landmarking religious properties.

iAsked staff to get information that might be helpful and useful on a presentation that was done (or an award handed out by the California Preservation Foundation) for temporary shoring of earthquake, damaged historic buildings.

iGave an update on the old firehouse at 1152 Oak Street.

iGave updates on the following projects:

- City Lights Bookstore landmark designation was heard before the Planning Commission on May 10. The Planning Commission unanimously approved the landmark designation and will forward the recommendation to the Board of Supervisors.

- There has been an amendment made to the memorandum of agreement for the Jewish Museum proposal for the Jessie Street Substation.

iInformation was given regarding the lawsuit against the owner(s) of the Belli Building.

5. APPROVAL OF THE MARCH 21, APRIL 4, APRIL 18, 2001 DRAFT ACTION MINUTES

March 21, 2001: Moved by Member Kotas (seconded by Skrondal) to approve the draft minutes with corrections on page 5 regarding 1338 Filbert Street ? President Kelley should not show ?Recused?, he voted aye to both motions, so the first motion should read: +4 ?4; the second motion should read: +6 ?2. Under the second motion, additional wording should be added to the first and third bullet (see final action minutes). The vote was unanimous - Finwall, Kelley, Kotas, Reidy, Shatara and Skrondal (Absent: Dearman, Ho-Belli and Magrane).

April 4, 2001: Moved by Member Shatara (seconded by Finwall) to approve the draft minutes. Vote was unanimous ? Finwall, Kelley, Kotas, Reidy, Shatara and Skrondal (Absent: Dearman, Ho-Belli and Magrane).

1934 SAN FRANCISCO WATERFRONT and GENERAL STRIKES. Request for the Landmarks Preservation Advisory Board review and adoption of the context statement for the 1934 San Francisco Waterfront and General Strikes.

i Member Kotas stated that he felt this context statement was one of the best summaries he had read.

iMember Reidy commented that the context statement was very well written, colorfully written and quite interesting. The statement also weaves in history of the events with critical buildings.

iMember Reidy made a motion to adopt the context statement based on the draft resolution. The vote was unanimous (Finwall, Kelley, Kotas, Reidy, Shatara and Skrondal) ? Absent: Dearman, Ho-Belli and Magrane.

nCertificates of Appropriateness

7. 2001.0339A (M. SNYDER: 575-6891)

274 BRANNAN STREET, The Hawley Terminal Building, north side between 1st and 2nd Streets. Assessor?s Block 3774, Lot 93. A contributory building to the South End Historic District. Built in 1924, the reinforced concrete building was originally used for public storage, and is now primarily used as a telecommunications facility. The Hawley Terminal Building is rated by San Francisco Heritage. The subject property is within an SSO (Service, Secondary Office) District and a 50-X Height and Bulk District. Request for a Certificate of Appropriateness to replace the storefront three bays in from the east with a fire rated wall and door.

Preliminary Recommendations: Approval

Action: Board Member Shatara moved (seconded by Kotas) to recommend approval of the Certificate of Appropriateness with modifications as follows: required that both altered bays be painted a uniform, dark color and that the Certificate of Appropriateness contain language reiterating that the Landmarks Board expects the project sponsor to return for reconsideration if the work changes.

8. 2001.0373A (M. SNYDER: 575-6891)

112 LIBERTY STREET, north side between Dolores and Guerrero Streets. Assessor?s Block 3607, Lot 43. A contributory building to the Liberty Hill Historic District. Built in 1884, this well intact two-story-over-garage Italianate structure was originally and is currently used as a single-family residents. It is within an RH-2 (House, Two-Family) District and a 40-X Height and Bulk District. Request for a Certificate of Appropriateness to add a three story addition to the rear of the building, raise the house by 1.5 feet, and make other renovations to the front façade.

Preliminary Recommendations: Approval

Action: Board Member Reidy made a motion (seconded by Skrondal) to approve one element to give guidance that the Landmarks Board would accept the raising of the building as proposed, but the matter is continued to another meeting (scheduled by Planning Staff) before the Landmarks Board. The Landmarks Board requested that special attention be given to the front of the entire property (all the elements, not just the stairs), do more research on historic photographs and take a look at some of the vertical window elements in the rear and give some consideration to it.

The subject property is City Landmark No. 183, is zoned C-3-0 (Downtown Office) District and is in a 500-S Height and Bulk District. Request for a Certificate of Appropriateness to install two antennae.

Action: Board Member Finwall moved (seconded by Skrondal) to accept Staff?s recommendation for approval of the Certificate of Appropriateness.

1268-1270 LOMBARD, north side between Polk and Larkin Streets. Assessor?s Block 500, Lot 15. A two-story, two-unit wood-frame early Victorian shingle-clad house. Consideration to initiate landmark designation of 1268-1270 Lombard Street as Landmark No. 229.

Board Comments

and Action:

i After hearing public testimony and discussions, Member Reidy (seconded by Magrane), made a motion that based today?s deliberation by the Landmarks Board, they cannot conclude that the subject property should be a landmark, because it does not meet the criteria that has been adopted by the Landmarks Board or the policies and regulations of Article 10. The motion is based on the following findings:

1.                  There are serious problems of integrity with the building.

2.                  The Landmarks Board would have difficulty concluding that the building is associated with important cultural, historical patterns in the history of San Francisco.

3.                  There are other readily available models of 1860s buildings around located elsewhere in San Francisco that are more in tact.

4.                  There are issues about the property ownership by a single family for at least 50 years; respecting the wishes of the property owner to use and enjoy their property.

5.                  There are issues about the impression of the building in its setting, that it doesn?t meet landmark status.
