§Introduced Sarah Owsowitz-Klein, Deputy City Attorney, who will be assigned to Landmarks Preservation.

§Planning Department?s Environmental Review Officer, Hillary Gitelman, is leaving the Department.

§Steade Craigo will hold a training session on the Secretary of the Interior Standards, Wednesday, April 25, 10 a.m. to 12 noon, 1660 Mission, Room 2001.

§California Preservation Foundation Conference will be held in San Diego, May 17-20.

i Briefed the Board and members of the public of the ongoing dispute at the Berkeley Landmarks Board.

Comments:

iThe Board had concerns regarding the replacement of the appliqué (garland) and asked if this replacement was specifically called out and noted as an element of the Certificate of Appropriate.

iEncouraged the project sponsors that if there are any savings in the budget or additional fund raisings, that the replacement of the appliqué (garland) will not be allowed to fall out, and be given some priority attention and be saved, if possible.

iThe Board feels that the appliqué (garland) is an important part of the aesthetic of the building.

iThe Board thanked the project sponsors for the informational presentation.

825 BATTERY STREET, west side between Broadway and Vallejo Street. A five-and-one-half-story reinforced concrete office building, built in 1907. The subject property is a contributory building in the Northeast Waterfront Historic District, is rated in the City's 1976 survey of architecturally significant buildings, is listed as being eligible for the National Register, and is in a C-2 (Community Business) District, and a 84-E Height and Bulk District. The subject building is formerly known as the American Biscuit Building. Request for a Certificate of Appropriateness to install ADA compliant entry on Battery Street frontage. (Continued from January 17, 2001 Hearing)

123 TOWNSEND STREET (a.k.a. 118 KING STREET), The Southern Pacific Warehouse, north side between Second and Third Streets. A six-story masonry building, built in 1903. The subject property is a contributory building in the South End Historic District, is rated ?A? by San Francisco Architectural Heritage, and is rated in the City's 1976 Architectural Survey, is within an M-2 (Heavy Industrial) District, and is within a 105-F Height and Bulk District. Request for a Certificate of Appropriateness to install primary and secondary business signs, and an address sign on the King Street façade, and to replace louver coverings to four windows with new windows that would match the building?s other windows.

261-271 COLUMBUS AVENUE, City Lights Bookstore, south side of street between Jack Kerouac Street and Broadway. Assessor?s Block 162, Lot 18. The subject project is zoned Broadway NCD and is in a 65-A-1 Height and Bulk District. Review and comment, and consideration to endorse the Context Statement ? Bohemian Literary Culture in Post-War San Francisco. Consideration to initiate landmark designation and adopt a resolution initiating and recommending landmark designation of the City Lights Bookstore as Landmark No. 228. (Note: This item was heard at the June 21, 2000 Landmarks Board Hearing. At that time, the Landmarks Board unanimously voted to endorse the Context Statement ? Bohemian Literary Culture in Post-War San Francisco; and initiate landmark designation and adopt a resolution initiating and recommending landmark designation of the City Lights Bookstore as Landmark No. 228 to the Planning Commission. This item was continued to September 20, 2000. At that hearing, the Landmarks Board unanimously voted to have President Reidy meet with the authors of the various reports and produce a final landmark designation report.)

iPresident Kelley was allowed to participate in the general discussion, but not vote or preside over this portion of the hearing, due to his initial involvement. Board Member Reidy was asked to preside as President.

iMembers of the Board stated that they thought the report was outstanding; liked the way the report was written.

iIt was suggested adopting the cover page with the graphics.

iIt was recommended accepting the report as is as a one of a kind document.

iPresident Kelley thanked Reidy for his participation in working with the owners and members of the public in an effort to put together a report incorporating everyone?s? comments and suggestions. Kelley expressed respect to the owners of City Lights Bookstore.

iKelley expressed his concerns regarding the creditability of the Landmarks Board, with regards to the report stating City Lights Bookstore has architectural significance. He suggested that the Landmarks Board uncheck the box labeled architectural significance. He stressed that the building should be landmarked for it cultural merits.

It was moved by Member Reidy (seconded by Magrane) to adopt the final landmark designation report. The vote was unanimous.

1338 FILBERT STREET, 1338 Filbert Cottages, historically known as the Bush Cottages (1907-1930s) and the School of Basic Design and Color (1940s), north side of Filbert Street between Polk and Larkin Streets. Assessor?s Block 524, Lots 31, 32, 33 and 34. Four, two-story wood frame cottages sited among brick walkways, patios, and mature plantings. The subject property is zoned (House, Two-Family) District and is in a 40-X Height and Bulk District. Request for Landmarks Preservation Advisory Board recommendation to the Planning Commission on the proposed landmark designation, which was initiated by the Board of Supervisors on January 26, 2001.

After hearing public testimony, the Landmarks Board commented as follows:

iAsked what was the intent of the property?

iAsked what happened to the easement between the Willis property and Larkin Street?

iWas a study done to save/protect the cottages?

iIt was expressed that the first draft report was much clearer then the final report presented at this hearing.

iMembers of the Board expressed their concerns regarding the notification process to the owner of the property of the potential landmark designation.

iStaff should have time to check the history of the property, and therefore, the members of the Board felt they did not have enough information, or at least enough significant information to make a decision.

iSuggested it could be labeled as a landmark based on the integrity of the cottages; additions attributed to the 1950s.

Member Reidy moved (seconded by Finwall) to recommend to the Planning Commission that the 1338 Filbert Street lot be positively considered a landmark with modifications to the report/resolution; raising the issue regarding the notification process.

Ayes: Dearman, Finwall, Kelley and Reidy

Noes: Ho-Belli, Kotas, Magrane and Skrondal

Absent: Shatara

THE MOTION DID NOT PASS +4 ?4

Member Magrane moved (seconded by Kotas) to take no action based on:

- Untimely receipt of report and notification to owners

- Lack of sufficient time for review of document

- Factual aspects of the report was disputed and the Board felt there was insufficient time to resolve them.

- No staff input

- Sufficient grounds to initiate site is/could be preservable

Ayes: Dearman, Ho-Belli, Kelley, Kotas, Magrane and Skrondal

Noes: Finwall and Reidy

Absent: Shatara
