Planning Code Articles 10 and 11 - Informational Presentation to discuss policy issues for preservation planning and the rewriting of Articles 10 (Preservation of Historical Architectural and Aesthetic Landmarks) and Article 11 (Preservation of Buildings and Districts of Architectural, Historical, and Aesthetic Importance in the C-3 Districts), and to discuss Board of Supervisors File No. 08-1565, an Ordinance that would rescind Articles 10 and 11 from the Planning Code in its entirety and adopt a new Article 10 and 11 to implement the provisions of the new San Francisco Charter Section 4.135 (Historic Preservation Commission).


Planning Staff identified these topics for discussion and presented the following recommendations:


(1) Under Power K in the Powers and Duties of the HPC, Ms. Sullivan recommended revising the proposed legislation to not create a new HPC review process for Categorical Exemptions. The HPC can retain their power over the Negative Declarations and Environmental Impact Reports;

(2) Regarding the appointment of the HPO, Ms. Sullivan recommended revising the proposed legislation to not create a similar appointment process as for the Planning Director (HPC provide three names to the Planning Director). She cited legal issues (civil service regulations) as well as staff morale as the primary concerns;

(3) For Historic District Designation, Ms. Sullivan recommended revising the proposed legislation to not only require design guidelines or standards, but also setback, height, and bulk controls. Ms. Sullivan also would like input on the definition for  Minor and  Major alteration; and

(4) On HPC powers on demolition in historic district;

(5) For multi-entitlement projects, Ms. Sullivan recommended revising the proposed legislation to establish review procedures for Variances and Discretionary Reviews.

Ms. Sullivan reminded everyone that the next hearing at the HPC for action is on Wednesday, April 8th and at the CPC for action is on Thursday, April 9th.
