A. PUBLIC COMMENT
At this time, members of the public may address the Historic Preservation Commission on items of interest to the public that are within the subject matter jurisdiction of the Historic Preservation Commission except agenda items. Public comment will be taken on each agendized item. Each member of the public may address the Commission for up to three minutes. If it is demonstrated that comments by the public will exceed 15 minutes, the President or chairperson may continue Public Comment to another time during the meeting.
The Brown Act forbids a commission or board from taking action or discussing any item not appearing on the posted agenda, including those items raised at public comment. In response to public comment, not on an agendized item, the Commission is limited to:
(1) briefly responding to statements made or questions posed by members of the public, or
(2) requesting staff to report back on a matter at a subsequent meeting, or
(3) directing staff to place the item on a future agenda. (Government Code Section 54954.2(a).).

- He presented a resolution for Mark Luellen; thanked him for all his contributions as a Preservation Tech Spec and Preservation Coordinator to the Landmarks Preservation Advisory Board, the Historic Preservation Commission and the Planning Department; and wished him the best in his new role as the Northeast Team Leader.

4. Planning Code Articles 10 and 11: Informational Presentation to discuss policy issues for preservation planning and the rewriting of Articles 10 (Preservation of Historical Architectural and Aesthetic Landmarks) and Article 11 (Preservation of Buildings and Districts of Architectural, Historical, and Aesthetic Importance in the C-3 Districts), and to discuss Board of Supervisors File No. 08-1565, an Ordinance that would rescind Articles 10 and 11 from 11 from the Planning Code in its entirety and adopt a new Article 10 and 11 to implement the provisions of the new San Francisco Charter Section 4.135 (Historic Preservation Commission).

D. LANDMARK DESIGNATION

2055 UNION STREET, Metro Theatre, between Webster and Buchanan Streets. Assessor's Block 0541, Lot 018 - Request for the Historic Preservation Commission to adopt a Resolution recommending to the Board of Supervisors that they approve the designation of the Metro Theatre unr Criterion A (Event) and Criterion C (Design/Construction). On November 8, 2007, the Board of Supervisors of the City and County of San Francisco passed Resolution No. 672-07 (File No. 071215) initiating landmark designation of the Metro Theatre (a.k.a. Metropolitan Theatre), located at 2055 Union Street, as a Landmark pursuant to Section 1004.1 of the San Francisco Planning Code. The resolution was adopted on December 4, 2007. Following the Board of Supervisor's initiation of the landmark designation process, the property owner also submitted an application to designate the Metro Theatre. On December 17, 2008, the Landmarks Preservation Advisory Board (LPAB) held a public hearing on the proposed designation and passed Resolution No. 630 recommending approval of the landmark designation. After the LPAB's hearing and recommendation but before a hearing by the Planning Commission on the landmark designation, a quorum of the Historic Preservation Commission was seated. Under new Charter section 4.135 (Proposition J, November 2008), the Historic Preservation Commission has authority to recommend approval, disapproval, or modification of landmark designations to the Board of Supervisors without referral or recommendation to the Planning Commission. Accordingly, the Historic Preservation Commission will review the proposed landmark designation and make a recommendation to the Board of Supervisors. The site is zoned Union Street NCD (Neighborhood Commercial District) and is in a 40-X Height and Bulk District.
Preliminary Recommendation: Recommend approval of the landmark designation to the Board of Supervisors.

ACTION: Commissioner Hasz motion to recommended approval of landmark designation of the Metro Theatre with the exterior and inside murals as features to be preserved. The motion failed (+3 -1).
