The proposal is to demolish the existing one-story church building (in a converted bank building) and construct a new 3 story building 11,625 square feet in area for the church with 11 off street parking spaces.

Amendments repealing Planning Code Section 825.1 and amending Planning Code Sections 135, 309.1, 318.3, 809, 825, and 827.Proposed Ordinance [Board File Number 071292]introduced by Supervisor Daly to apply many of the pedestrian-friendly provisions of the Rincon Hill Downtown Mixed Use Zoning District to all Downtown Residential Districts. Specifically, the proposed Ordinance would add design requirements to enhance the pedestrian environment including but not limited to controls for ground floor uses, transparency, wind protection, lighting, and sidewalk treatments, and making environmental findings and findings of consistency with the General Plan and priority policies of Planning Code Section 101.1.

Adoption of Commission Minutes– Charter Section 4.104 requires all commissioners to vote yes or no on all matters unless that commissioner is excused by a vote of the Commission. Commissioners may not be automatically excluded from a vote on the minutes because they did not attend the meeting.

9. Commission Comments/Questions (Tape IB)

  • . At this time, the Commission may discuss and take action to set the date of a Special Meeting and/or determine those items that could be placed on the agenda of the next meeting and other future meetings of the Planning Commission.

Commissioner Antonini

- Requested a copy to be distributed to the Commission of the City's Commission study about the article in the paper last week that talked about an understatement of population -- that there are more people living in San Francisco than [what] the census showed.

- Also, changes that have been disclosed in this study as to income levels and the twelve lowest income neighborhoods form 1990 to the time of the study and the amount of money spent on retail products outside of the neighborhoods.

- I thought this was a very important study to have because within the next couple of years we are going to be looking at the Housing Element questions.

Commissioner W. Lee

- A couple of request: maybe the City Attorney's Office can give us an update next week regarding the litigation on the Housing Element.

- Secondly, I'm requesting staff or the Director to give us the status of the Bicycle Plan that has been challenged.

- Requested Director [Rahaim] to meet with the Bicycle Coalition Director Cheng.

- Also, I would like some information on how the Bicycle Plan, as proposed, relates to the Eastern Neighborhoods.

Commissioner Sugaya

- Last week the San Francisco Architectural Heritage had their annual fundraising event and Director Rahaim attended.

Commissioner Olague

- I received a phone call from a member of the public regarding 2525 Mission [Street]. I will call to confirm the address and call staff to get an update.

- The Presidio is something that we will eventually be getting a brief on.

- We discussed the Academy of Arts and the Flower Mart but it seems that the Flower Mart is sort of an issue. Eventually I would like to understand what is going on with that site at some level. I will explain that later.

- There is something on the ballot. I keep hearing that 98 and 99 will have serious implications in terms of how zoning and planning take place in the City.

Director Rahaim

- My understanding is that we can do an objective analysis of the ballot but as staff or as a Commission, we are not to take a public position.

Commissioner Sugaya

- There was a recent article in the Examiner that Bryan O'Neil, Superintendent, has issued a letter that at this point he does not believe that the current proposal on the main playground is not a conformance with the plans at the Presidio.

C. DIRECTOR'S REPORT

10. Director's Announcements

John Rahaim

- On the Census study, we have it and definitely will get that to you.

- I have had a couple of discussion about the status on the Bicycle Plan EIR. There is team at MTA that was formed and are working on that.

- They have established a schedule and I will be happy to report on that next week.

Anmarie Rodgers

Land Use Committee

  • – Land marking the site pursuant to article 10. Passed to the Full Board recommending approval.
  • – This ordinance would include the newly proposed Excelsior Alcohol Restricted Use District into the larger fringe financial non-contiguous restricted use district. Passed to the Full Board recommending approval.
  • – The Committee asked for two amendments for the legislation: further definition of what would qualify as a historic theater, and to develop guidelines on how the various sign components could be used. Continued to next week.
  • Not heard and it will be heard next week.

Rules Committee

  • – It will be heard by the Full Board.

  • Passed.

  • Passed. It was amended that it would meet criteria and apply to be LEED certified and to specify the levels of affordability that the project should have.

The senior units on the site will have 100% affordable at levels equivalent to 50% of area median income. The remaining of the project will achieve 15% inclusionary or if state bonds financing is available, the remaining of the project will be expected to get 20% inclusionary units.

  • – The zoning map amendments passed. The Planning Code amendments have minor technical amendments correcting a typographical error and making final clarification regarding historic resource procedure. The Planning Code amendment will need to be read again next week. After that, all components will be before the Mayor for signature.
    1. b. Supervisor Peskin introduced code enforcement legislation that would: (1) expand Planning Code enforcement funds beyond just general advertising signs, (2) address the relocation of general advertising signs, (3) increase the inventory maintenance fee for these signs from $48 to $75, (4) provide that a violation of the Planning Code General Advertisement Signs Inventory will be a public nuisance, and (5) minor clarification and technical changes.
    2. c. Supervisor McGoldrick introduced an amendment to the sub-division code that would update and clarify the provisions for below market rate units under the condominium conversion program.

This property was approved in 2001 as industrial units and according to the conditions of approval no portion of the building shall be used for live/work or dwelling.

Tony Kelly, President of the Potrero Booster Association- Re: 1250 Missouri Street

- In the latest two printouts of the Planning Department's pipeline report, this property is listed as a residential project and I hope is an error because it is in an industrial zone that needs protection.

Jeremy Paul- Re: 487 Broadway

- This project started the process in July 2007 and it is on hold from the department because of a citation of an illegal use elsewhere in the building. It is unfair that this applicant is unable to get a hearing until other things beyond his control are resolved.

John Bardis

- You have a categorical exemption for the Academy of Arts University and it seems that you are going to be silent allowing them to do whatever they want.

400 DIVISADERO STREET- northeast corner at Oak Street; Lots 17, 18 and 19 in Assessor's Block 1216 - Request for Conditional Use Authorization to allow a temporary parking facility pursuant to Sections 209.7(c), 303(c) and 711.56 of the Planning Code. The site contains the Touchless Car Wash and a Shell service station. A portion of the site is designated for circulation and drying area for the car wash. The proposal is to allow for after-hours (from 7:00 p.m. to 2:00 a.m.) temporary parking of vehicles in the car wash circulation and drying area, in an NC-2 (Small-Scale Neighborhood Commercial) District with a 65-A Height and Bulk District, and an RH-3 (Residential, House, Three-Family) District with a 40-x Height and Bulk District.

First Source Hiring Ordinance- expanding scope of covered permits in Market and Octavia Plan [Board File 080235]On February 12, 2008, Supervisor Mirkarimi introduced an Ordinance amending the San Francisco Administrative Code by amending sections 83.2, 83.4, and 83.6 to: (1) expand the scope of permits that the ordinance applies to in the Market and Octavia Area Plan; (2) place new reporting requirements on the First Source Hiring Administration that include reporting first source statistics on permittees, as defined under the ordinance, and (3) require contractors and permittees to cooperate with reasonable requests for information from the First Source Hiring Administration. The proposed Ordinance is before the Commission so that it may recommend adoption, rejection, or adoption with modifications to the Board of Supervisors.

580 HAYES STREET- north side between Laguna and Octavia Streets, Lot 010 in Assessor's Block 0807 - Request for Conditional Use Authorization. The project requires Conditional Use Authorization for an institutional use above the ground floor, for a non-residential use larger than 3,000 square feet and for development of a lot larger than 10,000 square feet. The site is within the Hayes-Gough Neighborhood Commercial District, and a 50-X Height and Bulk District, but is to be rezoned under the pending Market and Octavia Area Plan Code Amendments to the Hayes-Gough Neighborhood Commercial Transit District and a 55-X Height and Bulk District. The project complies with the pending Code Amendments but does not comply with current zoning. The project proposes to demolish the existing building and construct a mixed use building containing approximately 2,700 square feet of ground floor retail space along Hayes Street, an assisted living facility of approximately 48 units, 42 independent living group housing units for seniors and 17 off-street parking spaces in an underground garage accessed off of Ivy Street. The proposed building would be 5 stories and 55 feet in height over a below grade basement, totaling approximately 63,000 square feet.

Preliminary Recommendation: Adopt a Motion of Intent to adopt a motion approving the project, with conditions, once the Market and Octavia Area Plan Code Amendments become effective.

The PUD includes 5 residential buildings, 28 off-street parking spaces, and requests exceptions for density, rear yard, open space, exposure, and height.

The project site is within an RC-4 (Residential-Commercial Combined, High-Density) District, the North of Market Residential Special Use District, and an 80-T Height and Bulk District.

- We have been working on this project for about 3 years and we think we have designed a project that is sensitive to the historic nature of the building.

- The end result will activate an underutilized space and provide much needed housing.

- We are creating a central courtyard for the building. This would provide light and air to the inbound units.

- We are also retaining the structural columns of this building and repairing windows on the second floor, which are historic.

It is important to understand that by initiating these changes on April 17th, the Commission will not make any decision or approval regarding the content of the Eastern Neighborhoods proposals. Initiation merely allows the Department to advertise for public hearings expected in mid-May to take public comment on the proposed Eastern Neighborhood Proposals. Discussion of the substance of the Eastern Neighborhoods proposals by the Planning Commission will begin with the first approval hearing, expected in mid-May, 2008.

By initiating the following items on April 17th, the Commission will not make any final decision regarding the content of the Eastern Neighborhoods proposals. Initiation allows the Department to advertise for public hearings expected in mid-May to take public comment on the proposed Eastern Neighborhood Proposals.

EASTERN NEIGHBORHOODS PROGRAM – INTENTION TO INITIATE AMENDMENTS TO THE GENERAL PLAN, PLANNING CODE AND ZONING MAP- The Eastern Neighborhoods Program encompasses the entirety or portions of 437 Assessor's Blocks in the following four neighborhoods: Mission (generally bounded by Division Street, Potrero Avenue, Cesar Chavez Street and Guerrero Street), Central Waterfront (generally bounded by 16th Street, the Bay, Islais Creek and Highway 280), East SoMa (generally bounded by portions of Mission Street, Folsom Street, The Embarcadero and 4th Street) and Showplace Square – Potrero Hill (generally bounded by Harrison Street, 7th Street/highway 280, 26th Street and Potrero Avenue). The exact geography of the Eastern Neighborhoods Program, including a list of all affected Assessor's Blocks and Lots, is available at http://en-hearings.sfplanning.org.

a) Consideration of a Resolution of Intention to initiate amendments to the San Francisco General Plan related to the Eastern Neighborhoods Program.

Pursuant to San Francisco Charter Section 4.105, and Planning Code Sec. 340, the Planning Commission will consider adopting a Resolution of Intention to Initiate amendments to the General Plan, including adding four new Area Plans, and making related amendments to the Commerce and Industry Element, Recreation and Open Space Element and the Central Waterfront Area Plan, South of Market Area Plan and Northeastern Waterfront Area Plan as well as the Land Use Index. Proposed amendments to the General Plan and Area Plans can be viewed at http://en-hearings.sfplanning.org.

Preliminary Recommendation: Approve a draft Resolution of Intention to initiate amendments to the General Plan and schedule a public hearing to consider the amendments.

Proposed Planning Code map amendments will a) update height and bulk districts, b) apply the RTO District and PDR-2 Districts in the Eastern Neighborhoods, and c) establish 13 new zoning districts.
