Market & Octavia Neighborhood Plan - Certification of Final Environmental Impact Report. The project area lies to the west of the City's downtown financial district and sits at the junction of several neighborhoods, including, Civic Center, Hayes Valley, Western Addition, South of Market, Inner Mission, the Castro, Duboce Triangle, Eureka Valley, and Upper Market. The proposed neighborhood plan would reclassify the existing zoning from Residential Districts (R), Neighborhood Commercial Districts (NCD's), Moderate-Scale Neighborhood Commercial (NC-3), and Heavy Commercial (C-M) to Downtown General Commercial Districts (C-3-G), Residential Transit Oriented (RTO), Neighborhood Commercial Transit Districts (NCT), Neighborhood Commercial-Transit, Moderate-Scale Mixed Use Districts (NCT-3). It would also increase height limits in certain areas and reduce height limits in other areas. The proposed zoning and height reclassifications would increase the potential for residential development in the area.

Preliminary Recommendation: Certify the Final Environmental Impact Report.

Please note: The public review period for the Draft Environmental Impact Report is closed. The Planning Commission does not conduct public review of Final EIRs. Public comments on the certification may be presented to the Planning Commission during the Public Comment portion of the Commission calendar.

Market & Octavia Neighborhood Plan - Adoption of CEQA Findings Related to EIR and Potential Project Approval Action. The project includes proposed amendments to the General Plan, Planning Code and Zoning Map. The project area lies to the west of the City's downtown financial district and sits at the junction of several neighborhoods, including, Civic Center, Hayes Valley, Western Addition, South of Market, Inner Mission, the Castro, Duboce Triangle, Eureka Valley, and Upper Market. 365 Douglass Street - east side between 19th and 20th Streets, Block 2599, Lot 031 - Mandatory Discretionary Review, under the Planning Commission's policy requiring review of new construction, under Building Permit Application number 2006.02.033732, in conjunction with the demolition of a single family dwelling under case 2006.0388D with Demolition Permit Application number 2006.02.03.3728. The proposal is to construct a new, three-story single-family dwelling. The subject property is located in a RH-2 (Residential, Two Units) District and a 40-X Height and Bulk District.

601 DUBOCE AVENUE- Lot 3539, Lot 001 - Appeal of a Preliminary Mitigated Negative Declaration for the proposed construction of a four-story medical office building ( MOB ) on a 52,000 square foot portion of two surface parking lots on the northeast corner of the California Pacific Medical Center Davies campus in the Duboce Triangle neighborhood. The 50,100 (46,000 as measured by the Planning Code) gross-square-foot MOB would contain offices, a Neuromuscular and Electroencephalogram Clinic, a pharmacy and admitting station for the existing ambulatory surgery department in the CPMC Hospital North Tower. Patient drop-off would be located adjacent the MOB's third floor, accessible via the existing Duboce Avenue service drive. The MOB would include two pedestrian entries: a southern entrance along Noe Street and a northern entrance located along Duboce Avenue across from the N-Judah MUNI stop. The project would result in removal of 75 onsite surface parking spaces; no new off-street parking spaces would be constructed as part of the project. Pedestrian and streetscape improvements, including a public plaza, landscaping and sidewalk widening along Noe Street would be undertaken as part of the project. The project site is in the RH-3 (Residential House, Three Family) Zoning District and the 65-D Height and Bulk District, and would require Conditional Use authorization for expansion of an institutional use in an RH-3 Zoning District, an amendment CPMC's Planned Unit Development, permits from the Department of Public Works for tree removal and new landscaping, as well as building permits from the Department of Building Inspection.

Preliminary Recommendation: Uphold Preliminary Mitigated Negative Declaration

601 DUBOCE AVENUE - southwest corner of Duboce Avenue and Noe Street; Lot 1 in Assessor's Block 3539 - Request for a Conditional Use Authorization for a Planned Unit Development pursuant to Planning Code Sections 303(c) and 304 to amend a previously approved CU/PUD authorization (Case No. 1987.847C, Motion No. M13255) and develop a new four-story, 46,000 gross-square-foot (gsf) clinic / medical office building (as measured by the Planning Code; 50,100 gsf without area reductions allowed by Sec. 102.9). The new building would contain a Neuromuscular and Electroencephalogram Clinic, offices, a pharmacy and an admitting station for the existing ambulatory surgery department in the CPMC Hospital North Tower. As a Planned Unit Development, the project is seeking modifications to Planning Code requirements for rear yard and independently accessible parking. B. COMMISSIONERS' QUESTIONS AND MATTERS

8. Commission Comments/Questions

  • Inquiries/Announcements. Without discussion, at this time Commissioners may make announcements or inquiries of staff regarding various matters of interest to the Commissioner(s).
  • Future Meetings/Agendas. At this time, the Commission may discuss and take action to set the date of a Special Meeting and/or determine those items that could be placed on the agenda of the next meeting and other future meetings of the Planning Commission.

Commissioner Antonini:

-At the Armory informational hearing I would like to know more about possible usage for condominiums or housing.

-It would be good to have a progress report on approved projects. For example: 15th and Mission, and 340-399 Fremont Street.

-I would also like to know what happened with 555 Haight – a communal residential in a 4-unit facility.

-I would like to have details on what happened with the Oakland Medical Dispensary.

-Section 315 – the below market/provision on affordable housing passed and I would like a detailed report.

Commissioner Olague:

-Regarding the Armory, I would like to hear how this industry conducts itself in terms of its hiring process.

Commissioner Moore:

-I would like the Armory presentation to include projects dealing with all aspects of housing.

-I received a letter from Kevin Reed about how the Green Cross in District 6 is having issues about edibles. I am providing a copy to Mr. Badiner and the City Attorney to talk about it in the future.

-We are still pending a meeting with DBI and I would like to see that scheduled.

Commissioner Bill Lee:

-Public has brought to my attention that the new business in the Armory does not fit the character of the neighborhood. I would like some guidance on the legal definition about that.

-I spoke with Mr. Reed and suggested that the first step is working with staff.

-Food is under the jurisdiction of the Health Department.

Mr. Badiner, Zoning Administrator:

-The major request for hearing the Armory has been scheduled.

-I will collect information from planners and include follow up reports on projects approved and include this in your packets.

-There will be a fair amount of information at the Armory meeting. The Project Sponsor would be able to respond in terms how they would operate.

-We are waiting for DBI to schedule the meeting. It should happen sometime in April.

Armory Informational hearing is scheduled for April 5th, 2007.

1. - Board of Supervisor's Committee: Nothing to report related to Planning Commission

2. - Full Board:

A)-Conditional Use for conversion of schools - Ordinance by Supervisor Pierce – Continued.

School District was present and questioned whether the ordinance is practical. Everybody agreed on a continuance.

B)-Lower Height Street – A proposed amendment that would require three year monitoring only on off-sale of alcohol. Substitute ordinance monitoring off and on sale of alcohol - Approved and passed out

C)-Housing amendment - Sec 315. It was a long hearing and I do not have the information right now on what the action was.

3. - Board of appeals

A)-1801-1803 Folsom St.- DR on a microcell antenna – Commission action was upheld.

B)-869 North Point –2 family dwelling units to convert to 3-family units – Continued.

-Yesterday was homeless count day. He submitted copy of letter sent to Supervisors.

-Hotels should provide rooms for homeless at 50% off, especially in cold season.

-All wars should cease. Let's take our role as the number one state to stop it.

Is opposed to a third facility. There are two present in the area.

Joel Yodowitz – Representing the Project Sponsor

-Every facility serves different neighborhood needs with minimal conflict.

-It benefits local business. He submitted a petition from hundreds of neighbors supporting the project.

Michael Williams

-I did a survey in the neighborhood and found out that there is both residential and business support for this project.

Andy

- Crunch will benefit the neighborhood and most of the businesses support it.

Melissa

-Believes it will benefit everybody in the neighborhood. It would bring new clientele to the area.

-This building has been empty for a long time. It is a good idea to give it usage.

Mandy Scott

-The building has been vacant for a long time. It would be something new in the block

-Architecturally, it would be hard to have any other kind of business because of its size and structure.

-The building is not on the historic register but it is eligible to be. Crunch would not alter the building but would keep the unique quality of it.

1723 UNION STREET - south side between Octavia and Gough Streets; Lot 001B, in Assessor's Block 0544 - Request for Conditional Use authorization under Planning Code Sections 121.1, 303, 725.21 and 725.27 to allow a personal service use with a use size greater than 2,499 sq. ft., and to allow the proposed use to operate before 6:00 a.m. in the Union Street Neighborhood Commercial District and a 40-X Height and Bulk District. The project consists of establishing an approximately 11,300 sq. ft. gym (d.b.a. Crunch) in a space that was previously occupied by a retail-clothing store (d.b.a. Georgiou). No expansion in the building envelope is proposed, although the proposal will increase the existing floor area from 10,157 sq. ft. to approximately 11,300 sq. ft. through interior alterations. No onsite parking is proposed or required. The proposed business hours are Monday thru Thursday, 5:30 a.m. to 10:00 p.m.; Friday, 5:30 a.m. to 8:00 p.m.; Saturday and Sunday, 8:00 a.m. to 8:00 p.m.
